| 11 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 14 | | SECTION 1. Section 42.050, Human Resources Code, is amended |
|---|
| 13 | 15 | | by adding Subsection (e) to read as follows: |
|---|
| 14 | 16 | | (e) The application for renewal of a day-care center or |
|---|
| 15 | 17 | | group day-care home license must require the license holder to |
|---|
| 16 | 18 | | disclose the total number of employees who left employment with the |
|---|
| 17 | 19 | | license holder during the preceding calendar year. |
|---|
| 18 | 20 | | SECTION 2. Section 42.052(f-1), Human Resources Code, is |
|---|
| 19 | 21 | | amended to read as follows: |
|---|
| 20 | 22 | | (f-1) The executive commissioner shall adopt rules |
|---|
| 21 | 23 | | governing the certification and registration renewal process for |
|---|
| 22 | 24 | | all certifications and registrations issued under this chapter. The |
|---|
| 23 | 25 | | rules must include: |
|---|
| 24 | 26 | | (1) renewal periods; |
|---|
| 25 | 27 | | (2) a process for staggered renewals; |
|---|
| 26 | 28 | | (3) a process for resolving a late application for |
|---|
| 27 | 29 | | renewal; |
|---|
| 28 | 30 | | (4) expiration dates; [and] |
|---|
| 29 | 31 | | (5) conditions for renewal; and |
|---|
| 30 | 32 | | (6) a requirement for a registered family home to |
|---|
| 31 | 33 | | disclose the total number of employees who left employment with the |
|---|
| 32 | 34 | | registration holder during the preceding calendar year. |
|---|
| 33 | 35 | | SECTION 3. Section 42.025, Human Resources Code, is amended |
|---|
| 34 | 36 | | by adding Subsection (a-1) to read as follows: |
|---|
| 35 | 37 | | (a-1) In addition to the information required under |
|---|
| 36 | 38 | | Subsection (a), the searchable database must include the employment |
|---|
| 37 | 39 | | information disclosed under Sections 42.050(e) and 42.052(f-1)(6). |

| 38 | 40 | | SECTION 4. As soon as practicable after the effective date |
|---|
| 39 | 41 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 40 | 42 | | Services Commission shall adopt rules necessary to implement the |
|---|
| 41 | 43 | | changes in law made by this Act. |
|---|
| 42 | 44 | | SECTION 5. The changes in law made by this Act apply only to |
|---|
| 43 | 45 | | a license or registration renewed on or after the effective date of |
|---|
| 44 | 46 | | this Act. A license or registration renewed before the effective |
|---|
| 45 | 47 | | date of this Act is governed by the law as it existed immediately |
|---|
| 46 | 48 | | before the effective date of this Act, and that law is continued in |
|---|
| 47 | 49 | | effect for that purpose. |
|---|
| 48 | 50 | | SECTION 6. This Act takes effect September 1, 2019. |
