55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to funding for open-enrollment charter schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 12.106, Education Code, is amended by
1010 amending Subsections (a-1) and (a-2) and adding Subsection (a-3) to
1111 read as follows:
1212 (a-1) In determining funding for an open-enrollment charter
1313 school under Subsection (a):
1414 (1) the adjustment [adjustments] under Section
1515 [Sections] 42.102 is [, 42.104, and 42.105 are] based on the average
1616 adjustment for the state; [and]
1717 (2) any [the] adjustment under Section 42.103 is
1818 [based on] the [average] adjustment [for the state] that would have
1919 been provided to the school under that section as it existed on
2020 January 1, 2018, if the school were a school district that contains
2121 less than 300 square miles;
2222 (3) Section 42.104 applies to the school as if the
2323 school were a school district; and
2424 (4) the adjustment under Section 42.105 is based on
2525 the average adjustment for the state but may be provided to the
2626 school only if the school would have been provided an adjustment
2727 under that section if the school were a school district.
2828 (a-2) The eligibility of an open-enrollment charter school
2929 for an adjustment under Subsection (a-1) based on the school's
3030 average daily attendance shall be determined on the basis of the
3131 total average daily attendance of:
3232 (1) all campuses operating under the school's charter;
3333 and
3434 (2) any additional campuses operated under a joint
3535 operation agreement to which the school is a party.
3636 (a-3) In addition to the funding provided by Subsection (a),
3737 a charter holder is entitled to receive for the open-enrollment
3838 charter school enrichment funding under Section 42.302 based on the
3939 state average tax effort.
4040 SECTION 2. This Act takes effect September 1, 2019.
