410 AN ACT
511 relating to the use by certain municipalities of a perpetual trust
612 fund for a cemetery.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 713.008, Health and Safety Code, is
915 amended to read as follows:
1016 Sec. 713.008. TERMINATION OF MUNICIPAL TRUST BY CERTAIN
1117 MUNICIPALITIES. (a) This section applies to the [The] governing
1218 body of a municipality in a county with a population of:
1319 (1) at least 128,000 but not more than 300,000; or
1420 (2) at least 20,000 but not more than 21,000.
1521 (b) The governing body of a municipality to which this
1622 section applies may abolish the municipality's perpetual trust fund
1723 for a cemetery and use the fund, including both principal and
1824 interest, for permanent improvements to the cemetery.
1925 SECTION 2. This Act takes effect September 1, 2019.
