410 AN ACT
511 relating to the statewide behavioral health coordinating council.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Chapter 531, Government Code, is amended by
814 adding Subchapter M-1 to read as follows:
915 SUBCHAPTER M-1. STATEWIDE BEHAVIORAL HEALTH COORDINATING COUNCIL
1016 Sec. 531.471. DEFINITION. In this subchapter, "council"
1117 means the statewide behavioral health coordinating council.
1218 Sec. 531.472. PURPOSE. The council is established to
1319 ensure a strategic statewide approach to behavioral health
1420 services.
1521 Sec. 531.473. COMPOSITION OF COUNCIL. (a) The council is
1622 composed of at least one representative designated by each of the
1723 following entities:
1824 (1) the governor's office;
1925 (2) the Texas Veterans Commission;
2026 (3) the commission;
2127 (4) the Department of State Health Services;
2228 (5) the Department of Family and Protective Services;
2329 (6) the Texas Civil Commitment Office;
2430 (7) The University of Texas Health Science Center at
2531 Houston;
2632 (8) The University of Texas Health Science Center at
2733 Tyler;
2834 (9) the Texas Tech University Health Sciences Center;
2935 (10) the Texas Department of Criminal Justice;
3036 (11) the Texas Correctional Office on Offenders with
3137 Medical or Mental Impairments;
3238 (12) the Commission on Jail Standards;
3339 (13) the Texas Indigent Defense Commission;
3440 (14) the court of criminal appeals;
3541 (15) the Texas Juvenile Justice Department;
3642 (16) the Texas Military Department;
3743 (17) the Texas Education Agency;
3844 (18) the Texas Workforce Commission;
3945 (19) the Health Professions Council, representing:
4046 (A) the State Board of Dental Examiners;
4147 (B) the Texas State Board of Pharmacy;
4248 (C) the State Board of Veterinary Medical
4349 Examiners;
4450 (D) the Texas Optometry Board;
4551 (E) the Texas Board of Nursing; and
4652 (F) the Texas Medical Board; and
4753 (20) the Texas Department of Housing and Community
4854 Affairs.
4955 (b) The executive commissioner shall determine the number
5056 of representatives that each entity may designate to serve on the
5157 council.
5258 (c) The council may authorize another state agency or
5359 institution that provides specific behavioral health services with
5460 the use of appropriated money to designate a representative to the
5561 council.
5662 (d) A council member serves at the pleasure of the
5763 designating entity.
5864 Sec. 531.474. PRESIDING OFFICER. The mental health
5965 statewide coordinator shall serve as the presiding officer of the
6066 council.
6167 Sec. 531.475. MEETINGS. The council shall meet at least
6268 once quarterly or more frequently at the call of the presiding
6369 officer.
6470 Sec. 531.476. POWERS AND DUTIES. The council:
6571 (1) shall develop and monitor the implementation of a
6672 five-year statewide behavioral health strategic plan;
6773 (2) shall develop a biennial coordinated statewide
6874 behavioral health expenditure proposal;
6975 (3) shall annually publish an updated inventory of
7076 behavioral health programs and services that are funded by the
7177 state that includes a description of how those programs and
7278 services further the purpose of the statewide behavioral health
7379 strategic plan;
7480 (4) may create subcommittees to carry out the
7581 council's duties under this subchapter; and
7682 (5) may facilitate opportunities to increase
7783 collaboration for the effective expenditure of available federal
7884 and state funds for behavioral and mental health services in this
7985 state.
8086 SECTION 2. This Act takes effect immediately if it receives
8187 a vote of two-thirds of all the members elected to each house, as
8288 provided by Section 39, Article III, Texas Constitution. If this
8389 Act does not receive the vote necessary for immediate effect, this
8490 Act takes effect September 1, 2019.
