7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 14 | | SECTION 1. Section 659.301(5), Government Code, is amended |
---|
9 | 15 | | to read as follows: |
---|
10 | 16 | | (5) "State employee" means an individual who: |
---|
11 | 17 | | (A) is a commissioned law enforcement officer of |
---|
12 | 18 | | the Department of Public Safety, the Texas Facilities Commission, |
---|
13 | 19 | | the Texas Alcoholic Beverage Commission, the Texas Department of |
---|
14 | 20 | | Criminal Justice, [or] the attorney general, or the insurance fraud |
---|
15 | 21 | | unit of the Texas Department of Insurance; |
---|
16 | 22 | | (B) is a commissioned security officer of the |
---|
17 | 23 | | comptroller; |
---|
18 | 24 | | (C) is a law enforcement officer commissioned by |
---|
19 | 25 | | the Parks and Wildlife Commission; |
---|
20 | 26 | | (D) is a commissioned peace officer of an |
---|
21 | 27 | | institution of higher education; |
---|
22 | 28 | | (E) is an employee or official of the Board of |
---|
23 | 29 | | Pardons and Paroles or the parole division of the Texas Department |
---|
24 | 30 | | of Criminal Justice if the employee or official has routine direct |
---|
25 | 31 | | contact with inmates of any penal or correctional institution or |
---|
26 | 32 | | with administratively released prisoners subject to the board's |
---|
27 | 33 | | jurisdiction; |
---|
28 | 34 | | (F) has been certified to the Employees |
---|
29 | 35 | | Retirement System of Texas under Section 815.505 as having begun |
---|
30 | 36 | | employment as a law enforcement officer or custodial officer, |
---|
31 | 37 | | unless the individual has been certified to the system as having |
---|
32 | 38 | | ceased employment as a law enforcement officer or custodial |
---|
33 | 39 | | officer; or |
---|
34 | 40 | | (G) before May 29, 1987, received hazardous duty |
---|
35 | 41 | | pay based on the terms of any state law if the individual holds a |
---|
36 | 42 | | position designated under that law as eligible for the pay. |
---|
37 | 43 | | SECTION 2. Section 661.918(a), Government Code, is amended |
---|
38 | 44 | | to read as follows: |
---|
39 | 45 | | (a) This section applies to a peace officer under Article |
---|
40 | 46 | | 2.12, Code of Criminal Procedure, who is commissioned as a law |
---|
41 | 47 | | enforcement officer or agent, including a ranger, by: |
---|
42 | 48 | | (1) the Public Safety Commission and the director of |
---|
43 | 49 | | the Department of Public Safety; |
---|
44 | 50 | | (2) the Parks and Wildlife Commission; |
---|
45 | 51 | | (3) the Texas Alcoholic Beverage Commission; [or] |
---|
46 | 52 | | (4) the attorney general; or |
---|
47 | 53 | | (5) the insurance fraud unit of the Texas Department |
---|
48 | 54 | | of Insurance. |
---|
49 | 55 | | SECTION 3. Section 701.104, Insurance Code, is amended by |
---|
50 | 56 | | adding Subsection (d) to read as follows: |
---|
51 | 57 | | (d) The commissioner shall ensure that a peace officer |
---|
52 | 58 | | commissioned under Subsection (a) is compensated according to |
---|
53 | 59 | | Schedule C of the position classification salary schedule |
---|
54 | 60 | | prescribed by the General Appropriations Act. |
---|
55 | 61 | | SECTION 4. (a) The classification officer in the office of |
---|
56 | 62 | | the state auditor shall classify the position of commissioned peace |
---|
57 | 63 | | officer employed by the insurance fraud unit of the Texas |
---|
58 | 64 | | Department of Insurance as a Schedule C position under the Texas |
---|
59 | 65 | | Position Classification Plan. |
---|
60 | 66 | | (b) The change made by the classification officer as |
---|
61 | 67 | | required by this section applies beginning with the state fiscal |
---|
62 | 68 | | biennium beginning September 1, 2019. |
---|
63 | 69 | | (c) This section expires September 1, 2021. |
---|
64 | 70 | | SECTION 5. Section 661.918(a), Government Code, as amended |
---|
65 | 71 | | by this Act, applies only to an injury that occurs on or after the |
---|
66 | 72 | | effective date of this Act. |
---|
67 | 73 | | SECTION 6. This Act takes effect September 1, 2019. |
