55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an Internet online dropout recovery education program
88 for students at risk of dropping out of school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.081, Education Code, is amended by
1111 amending Subsection (e-2) and adding Subsection (f-1) to read as
1212 follows:
1313 (e-2) An Internet online dropout recovery education program
1414 must:
1515 (1) include as a part of its curriculum credentials,
1616 certifications, or other course offerings that relate directly to
1717 employment opportunities in the state;
1818 (2) employ as faculty and administrators persons with
1919 baccalaureate or advanced degrees;
2020 (3) provide an academic coach and local advocate for
2121 each student;
2222 (4) use an individual learning plan to monitor each
2323 student's progress;
2424 (5) [establish satisfactory requirements for the
2525 monthly progress of students according to standards set by the
2626 commissioner;
2727 [(6)] provide a monthly report to the student's school
2828 district regarding the student's progress;
2929 (6) [(7)] perform satisfactorily according to
3030 performance indicators and accountability standards adopted for
3131 alternative education programs by the commissioner; and
3232 (7) [(8)] comply with this title and rules adopted
3333 under this title except as otherwise provided by this subsection.
3434 (f-1) An Internet online dropout recovery education program
3535 is not subject to commissioner rules applicable to an optional
3636 flexible school day program under Section 29.0822 regarding minutes
3737 of instruction and calculation of average daily attendance. For
3838 the purposes of calculating attendance for an Internet online
3939 dropout recovery education program, the commissioner shall:
4040 (1) consider a student to be scheduled for and
4141 receiving instruction for 55 minutes per day for each course taken
4242 for purposes of determining whether the student satisfies the
4343 requirements of half-day or full-day enrollment;
4444 (2) consider a student who is enrolled for five
4545 semester courses to be in attendance for each day of instruction in
4646 the reporting period for purposes of establishing the student's
4747 daily attendance;
4848 (3) calculate the final average daily attendance of
4949 the program based on successful student completion of semester
5050 courses in which students were enrolled using course completion
5151 data reported by the district;
5252 (4) adjust the average daily attendance based on
5353 students' failure to complete semester courses; and
5454 (5) adjust the amount of funding provided under the
5555 Foundation School Program during the following school year based on
5656 any adjustment made under Subdivision (4).
5757 SECTION 2. This Act takes effect September 1, 2019.
