86 AN ACT
9- relating to the training of peace officers on cases involving child
10- abuse and neglect, family violence, and sexual assault.
7+ relating to education and training for peace officers regarding
8+ trauma-informed interviewing of victims of sexual assault or other
9+ sex offenses.
1110 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 1701.253(b), Occupations Code, is
13- amended to read as follows:
14- (b) In establishing requirements under this section, the
15- commission shall require courses and programs to provide training
16- in:
17- (1) the recognition, investigation, and documentation
18- of cases that involve[:
19- [(A)] child abuse and [or] neglect, [;
20- [(B)] family violence, [;] and
21- [(C)] sexual assault, including the use of best
22- practices and trauma-informed response techniques to effectively
23- recognize, investigate, and document those cases;
24- (2) issues concerning sex offender characteristics;
25- and
26- (3) crime victims' rights under Chapter 56, Code of
27- Criminal Procedure, and Chapter 57, Family Code, and the duty of law
28- enforcement agencies to ensure that a victim is afforded those
29- rights.
30- SECTION 2. Section 1701.352(b), Occupations Code, is
31- amended to read as follows:
32- (b) The commission shall require a state, county, special
33- district, or municipal agency that appoints or employs peace
34- officers to provide each peace officer with a training program at
35- least once every 48 months that is approved by the commission and
36- consists of:
37- (1) topics selected by the agency; and
38- (2) for an officer holding only a basic proficiency
39- certificate, not more than 20 hours of education and training that
40- contain curricula incorporating the learning objectives developed
41- by the commission regarding:
42- (A) civil rights, racial sensitivity, and
43- cultural diversity;
44- (B) de-escalation and crisis intervention
45- techniques to facilitate interaction with persons with mental
46- impairments;
47- (C) de-escalation techniques to facilitate
48- interaction with members of the public, including techniques for
49- limiting the use of force resulting in bodily injury; and
50- (D) unless determined by the agency head to be
51- inconsistent with the officer's assigned duties:
52- (i) the recognition, investigation, and
53- documentation of cases that involve child abuse and [or] neglect,
54- family violence, and sexual assault, including the use of best
55- practices and trauma-informed response techniques to effectively
56- recognize, investigate, and document those cases; and
57- (ii) issues concerning sex offender
58- characteristics.
59- SECTION 3. Subchapter I, Chapter 1701, Occupations Code, is
60- amended by adding Section 1701.4045 to read as follows:
61- Sec. 1701.4045. CERTIFICATION OF OFFICERS FOR CHILD ABUSE
62- AND NEGLECT, FAMILY VIOLENCE, AND SEXUAL ASSAULT ASSIGNMENTS. (a)
63- The commission by rule shall establish minimum requirements for the
64- training, testing, and certification of special officers for
65- responding to allegations of child abuse and neglect, family
66- violence, and sexual assault.
67- (b) The commission may certify a peace officer as a special
68- officer for responding to allegations of child abuse and neglect,
69- family violence, and sexual assault if the person:
70- (1) completes an advanced training course
71- administered by the commission on recognizing, investigating, and
72- documenting cases involving child abuse and neglect, family
73- violence, and sexual assault using best practices and
74- trauma-informed response techniques; and
75- (2) passes an examination administered by the
76- commission that is designed to test the person's:
77- (A) knowledge and recognition of the signs of
78- child abuse and neglect, family violence, and sexual assault; and
79- (B) skill at investigating and documenting child
80- abuse and neglect, family violence, and sexual assault using best
81- practices and trauma-informed response techniques.
82- (c) The commission may issue a professional achievement or
83- proficiency certificate to a peace officer who meets the
84- requirements of Subsection (b).
85- SECTION 4. Not later than January 1, 2020, the Texas

12+ by adding Subsection (p) to read as follows:
13+ (p) As part of the minimum curriculum requirements, the
14+ commission shall establish and require an officer to complete a
15+ statewide comprehensive education and training program on
16+ trauma-informed interviewing of victims of sexual assault or other
17+ sex offenses. An officer shall complete the program not later than
18+ the second anniversary of the date the officer is licensed under
19+ this chapter or the date the officer applies for an intermediate
20+ proficiency certificate, whichever date is earlier.
21+ SECTION 2. Not later than January 1, 2020, the Texas
8622 Commission on Law Enforcement shall establish the comprehensive
87- education and training program required by Section 1701.253(b),
88- Occupations Code, as amended by this Act.
89- SECTION 5. As soon as practicable after the effective date
90- of this Act, the Texas Commission on Law Enforcement shall adopt
91- rules necessary to implement Section 1701.4045, Occupations Code,
92- as added by this Act.
93- SECTION 6. This Act takes effect September 1, 2019.
