| 7 | 7 | | relating to increasing the criminal punishment for assault |

| 8 | 8 | | committed against certain sports participants. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 22.01(c), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (c) An offense under Subsection (a)(2) or (3) is a Class C |
|---|
| 13 | 13 | | misdemeanor, except that the offense is[: |
|---|
| 14 | 14 | | [(1)] a Class A misdemeanor if the offense is |
|---|
| 15 | 15 | | committed: |
|---|
| 16 | 16 | | (1) under Subsection (a)(3) against an elderly |
|---|
| 17 | 17 | | individual or disabled individual, as those terms are defined by |
|---|
| 18 | 18 | | Section 22.04; |
|---|
| 19 | 19 | | (2) [a Class B misdemeanor if the offense is |
|---|
| 20 | 20 | | committed] by any [a] person, other than [who is not] a sports |
|---|
| 21 | 21 | | participant who is an athlete younger than 19 years of age, against |
|---|
| 22 | 22 | | another [a] person the actor knows is a sports participant either: |
|---|
| 23 | 23 | | (A) while the participant is performing duties or |
|---|
| 24 | 24 | | responsibilities in the participant's capacity as a sports |
|---|
| 25 | 25 | | participant; or |
|---|
| 26 | 26 | | (B) in retaliation for or on account of the |
|---|
| 27 | 27 | | participant's performance of a duty or responsibility within the |
|---|
| 28 | 28 | | participant's capacity as a sports participant; or |
|---|
| 29 | 29 | | (3) [a Class A misdemeanor if the offense is |
|---|
| 30 | 30 | | committed] against a pregnant individual to force the individual to |
|---|
| 31 | 31 | | have an abortion. |

| 32 | 32 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 33 | 33 | | to an offense committed on or after the effective date of this Act. |
|---|
| 34 | 34 | | An offense committed before the effective date of this Act is |
|---|
| 35 | 35 | | governed by the law in effect on the date the offense was committed, |
|---|
| 36 | 36 | | and the former law is continued in effect for that purpose. For |
|---|
| 37 | 37 | | purposes of this section, an offense was committed before the |
|---|
| 38 | 38 | | effective date of this Act if any element of the offense occurred |
|---|
| 39 | 39 | | before that date. |

| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2019. |
