55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal punishment for assault
88 committed against certain sports participants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.01(c), Penal Code, is amended to read
1111 as follows:
1212 (c) An offense under Subsection (a)(2) or (3) is a Class C
1313 misdemeanor, except that the offense is[:
1414 [(1)] a Class A misdemeanor if the offense is
1515 committed:
1616 (1) under Subsection (a)(3) against an elderly
1717 individual or disabled individual, as those terms are defined by
1818 Section 22.04;
1919 (2) [a Class B misdemeanor if the offense is
2020 committed] by any [a] person, other than [who is not] a sports
2121 participant who is an athlete younger than 19 years of age, against
2222 another [a] person the actor knows is a sports participant either:
2323 (A) while the participant is performing duties or
2424 responsibilities in the participant's capacity as a sports
2525 participant; or
2626 (B) in retaliation for or on account of the
2727 participant's performance of a duty or responsibility within the
2828 participant's capacity as a sports participant; or
2929 (3) [a Class A misdemeanor if the offense is
3030 committed] against a pregnant individual to force the individual to
3131 have an abortion.
3232 SECTION 2. The change in law made by this Act applies only
3333 to an offense committed on or after the effective date of this Act.
3434 An offense committed before the effective date of this Act is
3535 governed by the law in effect on the date the offense was committed,
3636 and the former law is continued in effect for that purpose. For
3737 purposes of this section, an offense was committed before the
3838 effective date of this Act if any element of the offense occurred
3939 before that date.
4040 SECTION 3. This Act takes effect September 1, 2019.
