9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to certain requirements for and limitations on
612 design-build contracts for highway projects of the Texas Department
713 of Transportation.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 223.242(d-1), Transportation Code, is
1016 amended to read as follows:
1117 (d-1) The department may not enter into more than six
1218 [three] contracts under this section in each state fiscal biennium
1319 [year].
1420 SECTION 2. Section 223.246(a), Transportation Code, is
1521 amended to read as follows:
1622 (a) The department shall issue a request for proposals to
1723 proposers short-listed under Section 223.245. A request for
1824 proposals must include:
1925 (1) information on the overall project goals;
2026 (2) publicly available cost estimates for the
2127 design-build portion of the project;
2228 (3) materials specifications;
2329 (4) special material requirements;
2430 (5) a [schematic] design approximately 30 percent
2531 complete;
2632 (6) known utilities, provided that the department is
2733 not required to undertake an effort to locate utilities;
2834 (7) quality assurance and quality control
2935 requirements;
3036 (8) the location of relevant structures;
3137 (9) notice of any rules or goals adopted by the
3238 department relating to awarding contracts to disadvantaged
3339 business enterprises or small business enterprises;
3440 (10) available geotechnical or other information
3541 related to the project;
3642 (11) the status of any environmental review of the
3743 project;
3844 (12) detailed instructions for preparing the
3945 technical proposal required under Subsection (d), including a
4046 description of the form and level of completeness of drawings
4147 expected;
4248 (13) the relative weighting of the technical and cost
4349 proposals required under Subsection (d) and the formula by which
4450 the proposals will be evaluated and ranked; and
4551 (14) the criteria to be used in evaluating the
4652 technical proposals, and the relative weighting of those criteria.
4753 SECTION 3. Section 223.246(a), Transportation Code, as
4854 amended by this Act, applies only to a highway project for which a
4955 request for qualifications is issued on or after the effective date
5056 of this Act. A highway project for which a request for
5157 qualifications is issued before the effective date of this Act is
5258 governed by the law in effect on the date the request for
5359 qualifications was issued, and that law is continued in effect for
5460 that purpose.
5561 SECTION 4. This Act takes effect September 1, 2019.
