4	10		AN ACT
5	11		relating to certain requirements for and limitations on
6	12		design-build contracts for highway projects of the Texas Department
7	13		of Transportation.
8	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	15		SECTION 1. Section 223.242(d-1), Transportation Code, is
10	16		amended to read as follows:
11	17		(d-1) The department may not enter into more than six
12	18		[three] contracts under this section in each state fiscal biennium
13	19		[year].
14	20		SECTION 2. Section 223.246(a), Transportation Code, is
15	21		amended to read as follows:
16	22		(a) The department shall issue a request for proposals to
17	23		proposers short-listed under Section 223.245. A request for
18	24		proposals must include:
19	25		(1) information on the overall project goals;
20	26		(2) publicly available cost estimates for the
21	27		design-build portion of the project;
22	28		(3) materials specifications;
23	29		(4) special material requirements;
24	30		(5) a [schematic] design approximately 30 percent
25	31		complete;
26	32		(6) known utilities, provided that the department is
27	33		not required to undertake an effort to locate utilities;
28	34		(7) quality assurance and quality control
29	35		requirements;
30	36		(8) the location of relevant structures;
31	37		(9) notice of any rules or goals adopted by the
32	38		department relating to awarding contracts to disadvantaged
33	39		business enterprises or small business enterprises;
34	40		(10) available geotechnical or other information
35	41		related to the project;
36	42		(11) the status of any environmental review of the
37	43		project;
38	44		(12) detailed instructions for preparing the
39	45		technical proposal required under Subsection (d), including a
40	46		description of the form and level of completeness of drawings
41	47		expected;
42	48		(13) the relative weighting of the technical and cost
43	49		proposals required under Subsection (d) and the formula by which
44	50		the proposals will be evaluated and ranked; and
45	51		(14) the criteria to be used in evaluating the
46	52		technical proposals, and the relative weighting of those criteria.
47	53		SECTION 3. Section 223.246(a), Transportation Code, as
48	54		amended by this Act, applies only to a highway project for which a
49	55		request for qualifications is issued on or after the effective date
50	56		of this Act. A highway project for which a request for
51	57		qualifications is issued before the effective date of this Act is
52	58		governed by the law in effect on the date the request for
53	59		qualifications was issued, and that law is continued in effect for
54	60		that purpose.
55	61		SECTION 4. This Act takes effect September 1, 2019.
