86 AN ACT
9- relating to the examinations required for a barbering or
10- cosmetology license.
7+ relating to the administration of a practical examination by a
8+ junior college or career school or college.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 1603.252(a), Occupations Code, is
13- amended to read as follows:
14- (a) The department may accept, approve, develop, or
15- contract for the examinations required by this chapter, including
16- the administration of the examinations.
17- SECTION 2. Section 1603.255, Occupations Code, is amended
18- to read as follows:
19- Sec. 1603.255. EARLY EXAMINATION. The department may
20- allow for the early written examination of a student who has
21- completed the following number of hours of instruction in a
22- department-approved training program:
23- (1) 1,000 hours for a student seeking a Class A barber
24- certificate [or operator license] in a private barber [or
25- cosmetology] school; [or]
26- (2) 900 hours for a student seeking a Class A barber
27- certificate [or operator license] in a publicly funded barber [or
28- cosmetology] school; or
29- (3) 1,000 hours, including 150 hours in sanitation and
30- safety, for a student seeking an operator license in a private
31- beauty culture school or a public secondary or postsecondary beauty
32- culture school.
33- SECTION 3. Section 1603.256(c), Occupations Code, is
34- amended to read as follows:
35- (c) The following persons may administer a practical
36- examination required under this subchapter:
37- (1) the department; [or]
38- (2) a person with whom the department contracts under
39- Section 1603.252;
40- (3) a barber school, private beauty culture school, or
41- public secondary or postsecondary beauty culture school that is
42- approved by the department to administer the examination under
43- Section 1603.252; or
44- (4) the Windham School District.
45- SECTION 4. The changes in law made by this Act to Section
46- 1603.255, Occupations Code, apply only to a person who applies to
47- take an early examination for a barbering or cosmetology license on
48- or after the effective date of this Act. A person who applies to
49- take an early examination before the effective date of this Act is
50- governed by the law in effect on the date the person applies, and
51- the former law is continued in effect for that purpose.
52- SECTION 5. This Act takes effect September 1, 2019.
10+ SECTION 1. Subchapter A, Chapter 132, Education Code, is
11+ amended by adding Section 132.007 to read as follows:
12+ Sec. 132.007. COSMETOLOGY TRAINING PROGRAM; PRACTICAL
13+ EXAMINATION REQUIREMENTS. (a) A public junior college or career
14+ school or college may administer any practical examination required
15+ by law for the practice of cosmetology.
16+ (b) Notwithstanding any other provision in the law, any
17+ person sitting for a professional exam for the practice of
18+ cosmetology must have completed a minimum of 1,000 hours of
19+ instruction, including a minimum of 150 hours of instruction in
20+ sanitation and safety, in a beauty culture course or in a vocational
21+ cosmetology program in a public school, including a junior college
22+ or career school or college.
23+ SECTION 2. This Act takes effect September 1, 2019.
