66 AN ACT
77 relating to the review under the Texas Sunset Act of the Texas
88 Education Agency's functions relating to special education
99 services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1212 amended by adding Section 29.0105 to read as follows:
1313 Sec. 29.0105. SUNSET PROVISION REGARDING SPECIAL SERVICES.
1414 (a) In this section, "federal letter" means the letter dated
1515 January 11, 2018, issued to the commissioner by the United States
1616 Department of Education Office of Special Education Programs
1717 addressing the results of that office's visit in Texas and its
1818 findings of noncompliance.
1919 (b) Separate from the review of the agency required under
2020 Section 7.004, the agency is subject to a limited review under
2121 Chapter 325, Government Code (Texas Sunset Act), of the agency's
2222 functions, including its supervisory and monitoring functions,
2323 relating to the provision of special services, except that those
2424 functions may not be abolished. The review shall be conducted
2525 during the period in which state agencies abolished in 2021 are
2626 reviewed.
2727 (c) The Sunset Advisory Commission shall limit the review
2828 under this section to:
2929 (1) the efficacy and effectiveness with which the
3030 agency administers its special services functions, including its
3131 supervisory and monitoring functions relating to the provision of
3232 special services; and
3333 (2) the corrective actions taken by the agency in
3434 response to each finding of noncompliance in the federal letter,
3535 including the extent to which the agency has implemented and is
3636 complying with its strategic plan and any updates to that plan
3737 adopted in response to the federal letter.
3838 (d) This section expires September 1, 2021.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2019.
