| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 29, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 29.0105 to read as follows: |
|---|
| 13 | 13 | | Sec. 29.0105. SUNSET PROVISION REGARDING SPECIAL SERVICES. |
|---|
| 14 | 14 | | (a) In this section, "federal letter" means the letter dated |
|---|
| 15 | 15 | | January 11, 2018, issued to the commissioner by the United States |
|---|
| 16 | 16 | | Department of Education Office of Special Education Programs |
|---|
| 17 | 17 | | addressing the results of that office's visit in Texas and its |
|---|
| 18 | 18 | | findings of noncompliance. |
|---|
| 19 | 19 | | (b) Separate from the review of the agency required under |
|---|
| 20 | 20 | | Section 7.004, the agency is subject to a limited review under |
|---|
| 21 | 21 | | Chapter 325, Government Code (Texas Sunset Act), of the agency's |
|---|
| 22 | 22 | | functions, including its supervisory and monitoring functions, |
|---|
| 23 | 23 | | relating to the provision of special services, except that those |
|---|
| 24 | 24 | | functions may not be abolished. The review shall be conducted |
|---|
| 25 | 25 | | during the period in which state agencies abolished in 2021 are |
|---|
| 26 | 26 | | reviewed. |
|---|
| 27 | 27 | | (c) The Sunset Advisory Commission shall limit the review |
|---|
| 28 | 28 | | under this section to: |
|---|
| 29 | 29 | | (1) the efficacy and effectiveness with which the |
|---|
| 30 | 30 | | agency administers its special services functions, including its |
|---|
| 31 | 31 | | supervisory and monitoring functions relating to the provision of |
|---|
| 32 | 32 | | special services; and |
|---|
| 33 | 33 | | (2) the corrective actions taken by the agency in |
|---|
| 34 | 34 | | response to each finding of noncompliance in the federal letter, |
|---|
| 35 | 35 | | including the extent to which the agency has implemented and is |
|---|
| 36 | 36 | | complying with its strategic plan and any updates to that plan |
|---|
| 37 | 37 | | adopted in response to the federal letter. |
|---|
| 38 | 38 | | (d) This section expires September 1, 2021. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2019. |
