12 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 11 | | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, |
---|
14 | 12 | | is amended by adding Sections 33.016 and 33.017 to read as follows: |
---|
15 | 13 | | Sec. 33.016. CERTAIN EXEMPTIONS FROM SNAP WORK REQUIREMENTS |
---|
16 | 14 | | PROHIBITED. The commission may not: |
---|
17 | 15 | | (1) request a waiver of the applicability of work |
---|
18 | 16 | | requirements as authorized under 7 U.S.C. Section 2015(o)(4); or |
---|
19 | 17 | | (2) provide an exemption from work requirements as |
---|
20 | 18 | | authorized under 7 U.S.C. Section 2015(o)(6). |

21 | 19 | | Sec. 33.017. EMPLOYMENT AND TRAINING SERVICES FOR CERTAIN |
---|
22 | | - | SNAP RECIPIENTS. The commission, in conjunction with the Texas |
---|
23 | | - | Workforce Commission, shall ensure that a person who is at least 18 |
---|
24 | | - | years of age but younger than 50 years of age, who has no |
---|
25 | | - | dependents, and who does not have a disability receives |
---|
26 | | - | supplemental nutrition assistance program employment and training |
---|
27 | | - | services unless the person is eligible for an individual waiver |
---|
28 | | - | under the program. |

29 | 28 | | SECTION 2. The changes in law made by this Act apply only to |

30 | 29 | | an initial determination or recertification of eligibility for the |
---|
31 | 30 | | supplemental nutrition assistance program under Chapter 33, Human |
---|
32 | 31 | | Resources Code, that is made on or after the effective date of this |
---|
33 | 32 | | Act. A determination or recertification made before the effective |
---|
34 | 33 | | date of this Act is governed by the law in effect on the date the |
---|
35 | 34 | | determination or recertification was made, and the former law is |
---|
36 | 35 | | continued in effect for that purpose. |
---|
37 | 36 | | SECTION 3. If before implementing any provision of this Act |
---|
38 | 37 | | a state agency determines that a waiver or authorization from a |
---|
39 | 38 | | federal agency is necessary for implementation of that provision, |
---|
40 | 39 | | the agency affected by the provision shall request the waiver or |
---|
41 | 40 | | authorization and may delay implementing that provision until the |
---|
42 | 41 | | waiver or authorization is granted. |
---|
43 | 42 | | SECTION 4. This Act takes effect September 1, 2019. |
