1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1412 is amended by adding Sections 33.016 and 33.017 to read as follows:
1513 Sec. 33.016. CERTAIN EXEMPTIONS FROM SNAP WORK REQUIREMENTS
1614 PROHIBITED. The commission may not:
1715 (1) request a waiver of the applicability of work
1816 requirements as authorized under 7 U.S.C. Section 2015(o)(4); or
1917 (2) provide an exemption from work requirements as
2018 authorized under 7 U.S.C. Section 2015(o)(6).
2119 Sec. 33.017. EMPLOYMENT AND TRAINING SERVICES FOR CERTAIN
22- SNAP RECIPIENTS. The commission, in conjunction with the Texas
23- Workforce Commission, shall ensure that a person who is at least 18
24- years of age but younger than 50 years of age, who has no
25- dependents, and who does not have a disability receives
26- supplemental nutrition assistance program employment and training
27- services unless the person is eligible for an individual waiver
28- under the program.
20+ SNAP RECIPIENTS. (a) This section applies to a person who is
21+ subject to the work requirements under 7 U.S.C. Section 2015(d)(1).
22+ This section does not apply to a person who is subject to the work
23+ requirements under 7 U.S.C. Section 2015(o)(2).
24+ (b) The commission, in conjunction with the Texas Workforce
25+ Commission, shall ensure that a person to whom this section applies
26+ receives supplemental nutrition assistance program employment and
27+ training services.
2928 SECTION 2. The changes in law made by this Act apply only to
3029 an initial determination or recertification of eligibility for the
3130 supplemental nutrition assistance program under Chapter 33, Human
3231 Resources Code, that is made on or after the effective date of this
3332 Act. A determination or recertification made before the effective
3433 date of this Act is governed by the law in effect on the date the
3534 determination or recertification was made, and the former law is
3635 continued in effect for that purpose.
3736 SECTION 3. If before implementing any provision of this Act
3837 a state agency determines that a waiver or authorization from a
3938 federal agency is necessary for implementation of that provision,
4039 the agency affected by the provision shall request the waiver or
4140 authorization and may delay implementing that provision until the
4241 waiver or authorization is granted.
4342 SECTION 4. This Act takes effect September 1, 2019.
