| 9 | 10 | SECTION 1. Subchapter C, Chapter 201, Transportation Code, | |
| 10 | 11 | is amended by adding Section 201.1056 to read as follows: | |
| 11 | 12 | Sec. 201.1056. AGREEMENTS FOR SERVICES ON FEDERAL MILITARY | |
| 12 | 13 | PROPERTY. (a) The department may enter into an agreement with the | |
| 13 | 14 | United States Department of Defense or other federal entity to | |
| 14 | 15 | allow the department to assist with the provision of road | |
| 15 | 16 | maintenance, improvement, relocation, or extension services for | |
| 16 | 17 | military installations. | |
| 17 | 18 | (b) State funds may not be used to provide services under an | |
| 18 | 19 | agreement entered into under this section. | |
| 19 | - | (c) Notwithstanding Subsection (a), the department may not | |
| 20 | - | enter into an agreement under this section if payment for the | |
| 21 | - | services provided under the agreement would be made from funds | |
| 22 | - | provided to the state for public roads under Title 23, United States | |
