55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the criminal offense of sexual
88 assault.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.011(f), Penal Code, is amended to
1111 read as follows:
1212 (f) An offense under this section is a felony of the second
1313 degree, except that an offense under this section is a felony of the
1414 first degree if the victim was, without regard to legitimacy, the
1515 actor's:
1616 (1) ancestor or descendant by blood or adoption; or
1717 (2) current or former stepchild or stepparent [a
1818 person whom the actor was prohibited from marrying or purporting to
1919 marry or with whom the actor was prohibited from living under the
2020 appearance of being married under Section 25.01].
2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect on the date the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2019.
