128 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
139 SECTION 1. The heading to Subchapter L, Chapter 2054,
1410 Government Code, is amended to read as follows:
1511 SUBCHAPTER L. STATEWIDE TECHNOLOGY CENTERS AND CLOUD COMPUTING
1612 SERVICES
1713 SECTION 2. Section 2054.375, Government Code, is amended by
18- amending Subdivision (1) and adding Subdivision (1-a) to read as
14+ 10 amending Subdivision (1) and adding Subdivision (1-a) to read as
1915 follows:
2016 (1) "Cloud computing service" has the meaning assigned
2117 by Section 2157.007.
2218 (1-a) "Governmental entity" means a state agency or
2319 local government.
2420 SECTION 3. Section 2054.378, Government Code, is amended to
2521 read as follows:
2622 Sec. 2054.378. AUTHORIZATION FOR CLOUD COMPUTING SERVICES
2723 OR SELECTION FOR CENTER SERVICES; SCOPE OF OPERATION OF CENTERS.
28- (a) The department shall allow a state agency at the agency's
29- discretion to:
30- (1) contract with a cloud computing service provider
31- for services described by Subsection (b); or
32- (2) use a statewide technology center for the services
33- described by Subsection (b).
24+ (a) The department shall:
25+ (1) allows a state agency to contract with a cloud
26+ computing service provider for services described by Subsection
27+ (b); or
28+ (2) allows a state agency to utilize services
29+ described by subsection (b) by a statewide technology center.
3430 (b) The department may operate statewide technology centers
3531 to provide two or more governmental entities, on a cost-sharing
3632 basis, services relating to:
3733 (1) information resources and information resources
3834 technology; and
3935 (2) the deployment, development, and maintenance of
4036 software applications.
4137 (c) [(b)] The department may operate a statewide technology
42- center directly or contract with a cloud computing service provider

4442 SECTION 4. Section 2054.382(a), Government Code, is amended

48- operations of statewide technology centers that provide data center
49- services or disaster recovery services for two or more state
50- agencies, including management of the operations of the center on
51- the campus of Angelo State University.

46+ that provide data center services or disaster recovery services for
47+ two or more state agencies, including management of the operations

5249 SECTION 5. Section 2054.384, Government Code, is amended to
5350 read as follows:
5451 Sec. 2054.384. COST AND REQUIREMENTS ANALYSIS. (a) Each
5552 state agency the department considers for participation under this
5653 subchapter [The department] shall conduct a cost and requirements
5754 analysis to determine the agency's information resource technology
5855 needs and shall consider using a cloud computing service, including
5956 any security benefits and cost savings associated with purchasing
6057 the service from a cloud computing service provider, or [for each
6158 state agency that the department intends to select for
6259 participation in] a statewide technology center.
6360 (b) A [selected] state agency shall identify the agency's
6461 [its] particular technology requirements, operations costs, and
65- requested service levels for the department. The department may

6966 SECTION 6. Section 2054.390, Government Code, is amended to

8784 Sec. 2054.392. STATEWIDE TECHNOLOGY ACCOUNT. The
8885 comptroller shall establish in the state treasury the statewide
89- technology account. The account is a revolving fund account for
90- the administration of this subchapter. The account is the
91- depository for all money received from entities served under this
92- subchapter. Money in the account may be used only for a [the
93- operation and management of a statewide technology center or for
94- any other] purpose specified by the legislature.
95- SECTION 8. The following provisions of the Government Code
96- are repealed:
97- (1) Sections 2054.382(c) and (d); and
98- (2) Section 2054.391.
