77 relating to the minimum wage.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 62.051, Labor Code, is amended to read as
1010 follows:
1111 Sec. 62.051. MINIMUM WAGE. (a) Except as provided by
1212 Sections 62.052 and [Section] 62.057, an employer shall pay to each
1313 employee not less than the greater of:
1414 (1) $10.10 an hour; or
1515 (2) the federal minimum wage under Section 6, Fair
1616 Labor Standards Act of 1938 (29 U.S.C. Section 206).
1717 (b) This subsection applies to wages paid by an employer for
1818 the 2020, 2021, 2022, and 2023 calendar years. Subsection (a) does
1919 not apply in a year to which this subsection applies. Except as
2020 provided by Sections 62.052 and 62.057:
2121 (1) for the 2020 and 2021 calendar years, an employer
2222 shall pay to each employee not less than the greater of:
2323 (A) $8.25 an hour; or
2424 (B) the federal minimum wage under Section 6,
2525 Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and
2626 (2) for the 2022 and 2023 calendar years, an employer
2727 shall pay to each employee not less than the greater of:
2828 (A) $9.25 an hour; or
2929 (B) the federal minimum wage under Section 6,
3030 Fair Labor Standards Act of 1938 (29 U.S.C. Section 206).
3131 (c) Subsection (b) and this subsection expire January 1,
3232 2024.
3333 SECTION 2. Section 62.052, Labor Code, is amended by
3434 amending Subsection (a) and adding Subsections (c) and (d) to read
3535 as follows:
3636 (a) In determining the wage of a tipped employee, the amount
3737 paid the employee by the employer may not be less than [is] the
3838 amount described as paid to a tipped employee under Section 3(m),
3939 Fair Labor Standards Act of 1938 (29 U.S.C. Section 203(m)), plus
4040 $2.85 an hour.
4141 (c) This subsection applies to wages paid by an employer for
4242 the 2020, 2021, 2022, and 2023 calendar years. Subsection (a) does
4343 not apply in a year to which this subsection applies. In
4444 determining the wage of a tipped employee, the amount paid the
4545 employee by the employer may not be less than the amount described
4646 as paid to a tipped employee under Section 3(m), Fair Labor
4747 Standards Act of 1938 (29 U.S.C. Section 203(m)), plus:
4848 (1) for the 2020 and 2021 calendar years, $1 an hour;
4949 and
5050 (2) for the 2022 and 2023 calendar years, $2 an hour.
5151 (d) Subsection (c) and this subsection expire January 1,
5252 2024.
5353 SECTION 3. Section 62.151, Labor Code, is repealed.
5454 SECTION 4. This Act takes effect January 1, 2020.
