	9	+	A BILL TO BE ENTITLED
4	10		AN ACT
5	11		relating to the authority of a commodity producers board or a
6	12		committee to hold meetings by telephone conference.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter D, Chapter 41, Agriculture Code, is
9	15		amended by adding Section 41.061 to read as follows:
10	16		Sec. 41.061. MEETINGS BY TELEPHONE CONFERENCE CALL. (a)
11	17		Notwithstanding Chapter 551, Government Code, a board or a
12	18		committee established by a board may hold an open or closed meeting
13	19		by telephone conference call if the convening at one location of a
14	20		quorum of the board or committee is inconvenient for any member of
15	21		the board or committee.
16	22		(b) The meeting is subject to the notice requirements
17	23		applicable to other meetings.
18	24		(c) The notice of the meeting must specify as the location
19	25		of the meeting the location where meetings of the board or
20	26		committee, as applicable, are usually held.
21	27		(d) Each part of the meeting that is required to be open to
22	28		the public shall be audible to the public at the location specified
23	29		in the notice of the meeting as the location of the meeting and the
24	30		audio shall be recorded. The audio recording shall be made
25	31		available to the public.
26	32		SECTION 2. This Act takes effect immediately if it receives
27	33		a vote of two-thirds of all the members elected to each house, as
28	34		provided by Section 39, Article III, Texas Constitution. If this
29	35		Act does not receive the vote necessary for immediate effect, this
30	36		Act takes effect September 1, 2019.
