76 AN ACT
87 relating to orders of nondisclosure for certain victims of
98 trafficking of persons.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 411.0728, Government Code, is amended to
1211 read as follows:
1312 Sec. 411.0728. PROCEDURE FOR CERTAIN VICTIMS OF TRAFFICKING
1413 OF PERSONS. (a) This section applies only to a person who is
1514 convicted of or[:
1615 [(1) who is] placed on deferred adjudication community
1716 supervision [under Chapter 42A, Code of Criminal Procedure, after
1817 conviction] for an offense under:
1918 (1) [(A)] Section 481.120, Health and Safety Code, if
2019 the offense is punishable under Subsection (b)(1);
2120 (2) [(B)] Section 481.121, Health and Safety Code, if
2221 the offense is punishable under Subsection (b)(1);
2322 (3) Section 30.05, Penal Code;
2423 (4) [(C)] Section 31.03, Penal Code, if the offense is
2524 punishable under Subsection (e)(1) or (2);
2625 (5) [(D)] Section 43.02, Penal Code; or
2726 (6) [(E)] Section 43.03(a)(2), Penal Code, if the
2827 offense is punishable as a state jail felony or as any lower
2928 category of offense [Class A misdemeanor; and
3029 [(2) with respect to whom the conviction is
3130 subsequently set aside by the court under Article 42A.701, Code of
3231 Criminal Procedure].
3332 (b) Notwithstanding any other provision of this subchapter
3433 or Subchapter F, a person described by Subsection (a) who satisfies
3534 the requirements of Section 411.074 may petition the court that
3635 convicted the person or placed the person on deferred adjudication
3736 community supervision for an order of nondisclosure of criminal
3837 history record information under this section on the grounds that
3938 the person committed the offense solely as a victim of trafficking
4039 of persons.
4140 (b-1) A petition under Subsection (b) must:
4241 (1) assert that the person seeking an order of
4342 nondisclosure under this section has not previously received an
4443 order of nondisclosure under this section; and
4544 (2) allege specific facts that, if proved, would
4645 establish that the petitioner committed the offense described by
4746 Subsection (a) solely as a victim of trafficking of persons.
4847 (c) After notice to the state, an opportunity for a hearing,
4948 a determination by the court that the person has not previously
5049 received an order of nondisclosure under this section, and a
5150 determination by the court that the person committed the offense
5251 described by Subsection (a) solely as a victim of trafficking of
5352 persons and that issuance of the order is in the best interest of
5453 justice, the court shall issue an order prohibiting criminal
5554 justice agencies from disclosing [to the public] criminal history
5655 record information related to the offense except as provided by
5756 Section 411.0765(a) [for which the defendant was placed on
5857 community supervision as described by Subsection (a)].
5958 (d) A person may petition the court that convicted the
6059 person or placed the person on deferred adjudication community
6160 supervision for an order of nondisclosure of criminal history
6261 record information under this section only on or after the 90th day
6362 after the date the person:
6463 (1) completed the sentence, including any term of
6564 confinement imposed and payment of all fines, costs, and
6665 restitution imposed; or
6766 (2) received a dismissal and discharge under Article
6867 42A.111, Code of Criminal Procedure, if the person was placed on
6968 deferred adjudication community supervision [person's conviction
7069 is set aside as described by Subsection (a)].
7170 SECTION 2. Section 411.0765, Government Code, is amended by
7271 adding Subsection (c) to read as follows:
7372 (c) Notwithstanding any other provision of this section, a
7473 criminal justice agency may not disclose criminal history record
7574 information that is the subject of an order of nondisclosure of
7675 criminal history record information under Section 411.0728 for
7776 regulatory licensing purposes or to an agency or entity listed in
7877 Subsection (b).
7978 SECTION 3. This Act takes effect September 1, 2019.
