66 AN ACT
77 relating to certain images captured by an unmanned aircraft.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 423.002(a), Government Code, is amended
1010 to read as follows:
1111 (a) It is lawful to capture an image using an unmanned
1212 aircraft in this state:
1313 (1) for the purpose of professional or scholarly
1414 research and development or for another academic purpose by a
1515 person acting on behalf of an institution of higher education or a
1616 private or independent institution of higher education, as those
1717 terms are defined by Section 61.003, Education Code, including a
1818 person who:
1919 (A) is a professor, employee, or student of the
2020 institution; or
2121 (B) is under contract with or otherwise acting
2222 under the direction or on behalf of the institution;
2323 (2) in airspace designated as a test site or range
2424 authorized by the Federal Aviation Administration for the purpose
2525 of integrating unmanned aircraft systems into the national
2626 airspace;
2727 (3) as part of an operation, exercise, or mission of
2828 any branch of the United States military;
2929 (4) if the image is captured by a satellite for the
3030 purposes of mapping;
3131 (5) if the image is captured by or for an electric or
3232 natural gas utility or a telecommunications provider:
3333 (A) for operations and maintenance of utility or
3434 telecommunications facilities for the purpose of maintaining
3535 utility or telecommunications system reliability and integrity;
3636 (B) for inspecting utility or telecommunications
3737 facilities to determine repair, maintenance, or replacement needs
3838 during and after construction of such facilities;
3939 (C) for assessing vegetation growth for the
4040 purpose of maintaining clearances on utility or telecommunications
4141 easements; and
4242 (D) for utility or telecommunications facility
4343 routing and siting for the purpose of providing utility or
4444 telecommunications service;
4545 (6) with the consent of the individual who owns or
4646 lawfully occupies the real property captured in the image;
4747 (7) pursuant to a valid search or arrest warrant;
4848 (8) if the image is captured by a law enforcement
4949 authority or a person who is under contract with or otherwise acting
5050 under the direction or on behalf of a law enforcement authority:
5151 (A) in immediate pursuit of a person law
5252 enforcement officers have reasonable suspicion or probable cause to
5353 suspect has committed an offense, not including misdemeanors or
5454 offenses punishable by a fine only;
5555 (B) for the purpose of documenting a crime scene
5656 where an offense, not including misdemeanors or offenses punishable
5757 by a fine only, has been committed;
5858 (C) for the purpose of investigating the scene
5959 of:
6060 (i) a human fatality;
6161 (ii) a motor vehicle accident causing death
6262 or serious bodily injury to a person; or
6363 (iii) any motor vehicle accident on a state
6464 highway or federal interstate or highway;
6565 (D) in connection with the search for a missing
6666 person;
6767 (E) for the purpose of conducting a high-risk
6868 tactical operation that poses a threat to human life;
6969 (F) of private property that is generally open to
7070 the public where the property owner consents to law enforcement
7171 public safety responsibilities; or
7272 (G) of real property or a person on real property
7373 that is within 25 miles of the United States border for the sole
7474 purpose of ensuring border security;
7575 (9) if the image is captured by state or local law
7676 enforcement authorities, or a person who is under contract with or
7777 otherwise acting under the direction or on behalf of state
7878 authorities, for the purpose of:
7979 (A) surveying the scene of a catastrophe or other
8080 damage to determine whether a state of emergency should be
8181 declared;
8282 (B) preserving public safety, protecting
8383 property, or surveying damage or contamination during a lawfully
8484 declared state of emergency; or
8585 (C) conducting routine air quality sampling and
8686 monitoring, as provided by state or local law;
8787 (10) at the scene of a spill, or a suspected spill, of
8888 hazardous materials;
8989 (11) for the purpose of fire suppression;
9090 (12) for the purpose of rescuing a person whose life or
9191 well-being is in imminent danger;
9292 (13) if the image is captured by a Texas licensed real
9393 estate broker in connection with the marketing, sale, or financing
9494 of real property, provided that no individual is identifiable in
9595 the image;
9696 (14) from a height no more than eight feet above
9797 ground level in a public place, if the image was captured without
9898 using any electronic, mechanical, or other means to amplify the
9999 image beyond normal human perception;
100100 (15) of public real property or a person on that
101101 property;
102102 (16) if the image is captured by the owner or operator
103103 of an oil, gas, water, or other pipeline for the purpose of
104104 inspecting, maintaining, or repairing pipelines or other related
105105 facilities, and is captured without the intent to conduct
106106 surveillance on an individual or real property located in this
107107 state;
108108 (17) in connection with oil pipeline safety and rig
109109 protection;
110110 (18) in connection with port authority surveillance
111111 and security;
112112 (19) if the image is captured by a registered
113113 professional land surveyor in connection with the practice of
114114 professional surveying, as those terms are defined by Section
115115 1071.002, Occupations Code, provided that no individual is
116116 identifiable in the image;
117117 (20) if the image is captured by a professional
118118 engineer licensed under Subchapter G, Chapter 1001, Occupations
119119 Code, in connection with the practice of engineering, as defined by
120120 Section 1001.003, Occupations Code, provided that no individual is
121121 identifiable in the image; [or]
122122 (21) if:
123123 (A) the image is captured by an employee of an
124124 insurance company or of an affiliate of the company in connection
125125 with the underwriting of an insurance policy, or the rating or
126126 adjusting of an insurance claim, regarding real property or a
127127 structure on real property; and
128128 (B) the operator of the unmanned aircraft is
129129 authorized by the Federal Aviation Administration to conduct
130130 operations within the airspace from which the image is captured; or
131131 (22) if the image is captured for the purpose of
132132 disaster preparedness, including for the inspection, maintenance,
133133 or repair of public infrastructure, by:
134134 (A) a county with a population of 550,000 or more
135135 that is adjacent to a county with a population of 3.3 million or
136136 more; or
137137 (B) a person who is under contract with or
138138 otherwise acting under the direction or on behalf of a county
139139 described by Paragraph (A).
140140 SECTION 2. This Act takes effect September 1, 2019.
