55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain criminal defendants for an
88 order of nondisclosure of criminal history record information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.073(b), Government Code, is amended
1111 to read as follows:
1212 (b) Notwithstanding any other provision of this subchapter
1313 or Subchapter F, a person described by Subsection (a) whose
1414 community supervision is not revoked and who completes the period
1515 of community supervision, including any term of confinement imposed
1616 and payment of all fines, costs, and restitution imposed, may
1717 petition the court that placed the person on community supervision
1818 for an order of nondisclosure of criminal history record
1919 information under this section if the person:
2020 (1) satisfies the requirements of this section and
2121 Section 411.074; and
2222 (2) has never been previously convicted of or placed
2323 on deferred adjudication community supervision for:
2424 (A) a felony; or
2525 (B) a misdemeanor under Chapter 20, 21, 22, 25,
2626 42, 43, 46, or 71, Penal Code [another offense other than a traffic
2727 offense that is punishable by fine only].
2828 SECTION 2. Section 411.0735(b), Government Code, is amended
2929 to read as follows:
3030 (b) Notwithstanding any other provision of this subchapter
3131 or Subchapter F, a person described by Subsection (a) who completes
3232 the person's sentence, including any term of confinement imposed
3333 and payment of all fines, costs, and restitution imposed, may
3434 petition the court that imposed the sentence for an order of
3535 nondisclosure of criminal history record information under this
3636 section if the person:
3737 (1) satisfies the requirements of this section and
3838 Section 411.074; and
3939 (2) has never been previously convicted of or placed
4040 on deferred adjudication community supervision for:
4141 (A) a felony; or
4242 (B) a misdemeanor under Chapter 20, 21, 22, 25,
4343 42, 43, 46, or 71, Penal Code [another offense other than a traffic
4444 offense that is punishable by fine only].
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2019.
