55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of state aid to certain local governments
88 disproportionately affected by the granting of ad valorem tax
99 relief to disabled veterans.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 140.011(a)(1) and (2), Local Government
1212 Code, are amended to read as follows:
1313 (1) "General fund revenue" means revenue generated by
1414 a local government from any source [the following sources] during a
1515 fiscal year and deposited in the dedicated general operating fund
1616 of the local government during that fiscal year, including, if
1717 applicable:
1818 (A) ad valorem taxes;
1919 (B) sales and use taxes;
2020 (C) franchise taxes, fees, or assessments
2121 charged for use of the local government's right-of-way;
2222 (D) building and development fees, including
2323 permit and inspection fees;
2424 (E) court fines and fees;
2525 (F) other fees, assessments, and charges; and
2626 (G) interest earned by the local government.
2727 (2) "Local government" means:
2828 (A) a municipality adjacent to a United States
2929 military installation; [and]
3030 (B) a county in which a United States military
3131 installation is wholly or partly located; and
3232 (C) a junior college district located wholly or
3333 partly in a municipality described by Paragraph (A).
3434 SECTION 2. The change in law made by this Act applies to the
3535 eligibility of a qualified local government to apply for a disabled
3636 veteran assistance payment beginning with the fiscal year of the
3737 local government that ends in the 2019 tax year.
3838 SECTION 3. This Act takes effect September 1, 2019.
