55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of the port commission of the Port of
88 Corpus Christi Authority of Nueces County, Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1A, Chapter 397, Acts of the 68th
1111 Legislature, Regular Session, 1983, as added by Chapter 498, Acts
1212 of the 81st Legislature, Regular Session, 2009, is amended to read
1313 as follows:
1414 Sec. 1A. COMPOSITION OF PORT COMMISSION. The port
1515 commission is composed of seven port commissioners [members].
1616 SECTION 2. Section 2(a), Chapter 397, Acts of the 68th
1717 Legislature, Regular Session, 1983, is amended to read as follows:
1818 (a) Port commissioners are appointed as follows:
1919 (1) the commissioners court [The Commissioners Court]
2020 of Nueces County shall appoint two port commissioners;
2121 (2) the city council of the City of Corpus Christi
2222 shall appoint three port commissioners; and
2323 (3) the commissioners court of San Patricio County
2424 shall appoint two port commissioners [four members to the port
2525 commission, and the City Council of Corpus Christi shall appoint
2626 three members to the port commission].
2727 SECTION 3. Sections 1, 2, 3, and 4, Chapter 1334, Acts of
2828 the 78th Legislature, Regular Session, 2003, are repealed.
2929 SECTION 4. The change in law made by this Act does not
3030 affect the term of a port commissioner of the port commission of the
3131 Port of Corpus Christi Authority of Nueces County, Texas, serving
3232 on the effective date of this Act. Port commissioners appointed to
3333 fill vacancies occurring on or after the effective date of this Act
3434 must be appointed in accordance with Section 2(a), Chapter 397,
3535 Acts of the 68th Legislature, Regular Session, 1983, as amended by
3636 this Act.
3737 SECTION 5. To the extent of any conflict, this Act prevails
3838 over another Act of the 86th Legislature, Regular Session, 2019,
3939 relating to nonsubstantive additions to and corrections in enacted
4040 codes.
4141 SECTION 6. (a) The legal notice of the intention to
4242 introduce this Act, setting forth the general substance of this
4343 Act, has been published as provided by law, and the notice and a
4444 copy of this Act have been furnished to all persons, agencies,
4545 officials, or entities to which they are required to be furnished
4646 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4747 Government Code.
4848 (b) The governor, one of the required recipients, has
4949 submitted the notice and Act to the Texas Commission on
5050 Environmental Quality.
5151 (c) The Texas Commission on Environmental Quality has filed
5252 its recommendations relating to this Act with the governor, the
5353 lieutenant governor, and the speaker of the house of
5454 representatives within the required time.
5555 (d) All requirements of the constitution and laws of this
5656 state and the rules and procedures of the legislature with respect
5757 to the notice, introduction, and passage of this Act are fulfilled
5858 and accomplished.
5959 SECTION 7. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2019.
