6	6	AN ACT
7	7	relating to the composition of the port commission of the Port of
8	8	Corpus Christi Authority of Nueces County, Texas.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1A, Chapter 397, Acts of the 68th
11	11	Legislature, Regular Session, 1983, as added by Chapter 498, Acts
12	12	of the 81st Legislature, Regular Session, 2009, is amended to read
13	13	as follows:
14	14	Sec. 1A. COMPOSITION OF PORT COMMISSION. The port
15	15	commission is composed of seven port commissioners [members].
16	16	SECTION 2. Section 2(a), Chapter 397, Acts of the 68th
17	17	Legislature, Regular Session, 1983, is amended to read as follows:
18	18	(a) Port commissioners are appointed as follows:
19	19	(1) the commissioners court [The Commissioners Court]
20	20	of Nueces County shall appoint two port commissioners;
21	21	(2) the city council of the City of Corpus Christi
22	22	shall appoint three port commissioners; and
23	23	(3) the commissioners court of San Patricio County
24	24	shall appoint two port commissioners [four members to the port
25	25	commission, and the City Council of Corpus Christi shall appoint
26	26	three members to the port commission].
27	27	SECTION 3. Sections 1, 2, 3, and 4, Chapter 1334, Acts of
28	28	the 78th Legislature, Regular Session, 2003, are repealed.
29	29	SECTION 4. The change in law made by this Act does not
30	30	affect the term of a port commissioner of the port commission of the
31	31	Port of Corpus Christi Authority of Nueces County, Texas, serving
32	32	on the effective date of this Act. Port commissioners appointed to
33	33	fill vacancies occurring on or after the effective date of this Act
34	34	must be appointed in accordance with Section 2(a), Chapter 397,
35	35	Acts of the 68th Legislature, Regular Session, 1983, as amended by
36	36	this Act.
37	37	SECTION 5. To the extent of any conflict, this Act prevails
38	38	over another Act of the 86th Legislature, Regular Session, 2019,
39	39	relating to nonsubstantive additions to and corrections in enacted
40	40	codes.
41	41	SECTION 6. (a) The legal notice of the intention to
42	42	introduce this Act, setting forth the general substance of this
43	43	Act, has been published as provided by law, and the notice and a
44	44	copy of this Act have been furnished to all persons, agencies,
45	45	officials, or entities to which they are required to be furnished
46	46	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
47	47	Government Code.
48	48	(b) The governor, one of the required recipients, has
49	49	submitted the notice and Act to the Texas Commission on
50	50	Environmental Quality.
51	51	(c) The Texas Commission on Environmental Quality has filed
52	52	its recommendations relating to this Act with the governor, the
53	53	lieutenant governor, and the speaker of the house of
54	54	representatives within the required time.
55	55	(d) All requirements of the constitution and laws of this
56	56	state and the rules and procedures of the legislature with respect
57	57	to the notice, introduction, and passage of this Act are fulfilled
58	58	and accomplished.
59	59	SECTION 7. This Act takes effect immediately if it receives
60	60	a vote of two-thirds of all the members elected to each house, as
61	61	provided by Section 39, Article III, Texas Constitution. If this
62	62	Act does not receive the vote necessary for immediate effect, this
63	63	Act takes effect September 1, 2019.
