55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the family first prevention
88 services task force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section, "task force" means the
1111 family first prevention services task force established under this
1212 section.
1313 (b) The family first prevention services task force is
1414 established for the purpose of assessing the readiness of this
1515 state in implementing Title VII, Div. E, Pub. L. No. 115-123 by
1616 2021.
1717 (c) The task force is composed of at least 19 members
1818 appointed by the commissioner of the Department of Family and
1919 Protective Services as follows:
2020 (1) the commissioner of family and protective
2121 services;
2222 (2) the assistant commissioner of child protective
2323 services;
2424 (3) the assistant commissioner of prevention and early
2525 intervention services;
2626 (4) the medical director of the department;
2727 (5) a representative from a single source continuum
2828 contractor;
2929 (6) a representative of a child-placing agency in this
3030 state with experience in managing a residential treatment center;
3131 (7) a representative of court-appointed volunteer
3232 advocates;
3333 (8) a judge of a court that hears suits affecting the
3434 parent-child relationship;
3535 (9) an attorney ad litem with experience in
3636 court-ordered representation of children and youth in the
3737 conservatorship of the department;
3838 (10) an advocate for foster children and youth who is
3939 not employed by or under contract with the department;
4040 (11) a representative of the legislature;
4141 (12) a representative of the Legislative Budget Board;
4242 (13) a representative of the office of the comptroller
4343 of public accounts;
4444 (14) three advocates who are not employed by or under
4545 contract with the department and who advocate for providing
4646 services to families at risk of entering the foster care system,
4747 including an advocate for the substance abuse treatment community,
4848 an advocate for the mental health treatment community, and an
4949 advocate with experience in providing services to pregnant and
5050 parenting youth;
5151 (15) an advocate with experience as a foster child;
5252 (16) an advocate with experience as a parent in the
5353 foster care system;
5454 (17) an advocate with experience as a kinship
5555 caregiver; and
5656 (18) any other member of the department's executive
5757 staff the commissioner considers necessary.
5858 (d) The commissioner of family and protective services
5959 serves as the presiding officer of the task force.
6060 (e) A vacancy for an appointed member of the task force is
6161 filled in the same manner as the original appointment.
6262 (f) The task force shall meet at least quarterly at the call
6363 of the presiding officer. The task force shall meet at other times
6464 as determined by the presiding officer.
6565 (g) The task force shall:
6666 (1) evaluate and make recommendations on matters
6767 related to the task force's purpose as described by Subsection (b)
6868 of this section, including:
6969 (A) the transformation of the placement of foster
7070 children and youth from residential treatment centers to qualified
7171 residential treatment providers and the process for certifying an
7272 unaccredited residential treatment center;
7373 (B) the total capacity of all foster care
7474 placements in this state;
7575 (C) the foster care prevention and early
7676 intervention strategies currently available in this state;
7777 (D) any issue that may arise in a suit affecting
7878 the parent-child relationship for a child or youth in the
7979 conservatorship of the department;
8080 (E) any issue relating to families entering the
8181 child protective services system; and
8282 (F) methods for using federal and state money to
8383 allow a greater number of children and youth to remain in their
8484 homes while addressing safety concerns for the children and youth;
8585 and
8686 (2) examine the costs to this state and the private
8787 sector and other issues related to the use of federal money
8888 allocated or transferred under Title VII, Div. E, Pub. L. No.
8989 115-123.
9090 (h) The Department of Family and Protective Services shall
9191 provide reasonably necessary administrative and technical support
9292 to the task force.
9393 (i) The task force shall prepare a written report that
9494 includes:
9595 (1) a description of the activities of the task force;
9696 (2) the findings and recommendations of the task
9797 force; and
9898 (3) proposed legislation, recommendations, or
9999 information on any other relevant matter that the task force
100100 considers appropriate.
101101 (j) Not later than January 1, 2021, the task force shall
102102 submit the report described by Subsection (i) of this section to the
103103 governor, the lieutenant governor, and each member of the
104104 legislature.
105105 (k) The task force is abolished and this section expires
106106 June 1, 2021.
107107 SECTION 2. This Act takes effect immediately if it receives
108108 a vote of two-thirds of all the members elected to each house, as
109109 provided by Section 39, Article III, Texas Constitution. If this
110110 Act does not receive the vote necessary for immediate effect, this
111111 Act takes effect September 1, 2019.
