79 AN ACT
810 relating to the administration of an examination and issuance of a
911 temporary receipt for a driver's license by an entity other than the
1012 Department of Public Safety.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 521.165, Transportation Code, is amended
1315 by amending Subsection (e) and adding Subsection (f) to read as
1416 follows:
1517 (e) The department may authorize and set standards for an
1618 entity described by Subsection (a), including a driver education
1719 school described by Section 521.1655, to administer, and train and
1820 certify examiners to administer, the examination required by
1921 Section 521.161(b)(2).
2022 (f) An entity described by Subsection (a) may not issue a
2123 temporary receipt under Section 521.1812 to a person who has not
2224 completed and passed the training and testing conducted by the
2325 entity under this section.
2426 SECTION 2. Subchapter I, Chapter 521, Transportation Code,
2527 is amended by adding Section 521.1812 to read as follows:
2628 Sec. 521.1812. ISSUANCE OF TEMPORARY RECEIPT BY THIRD
2729 PARTY. (a) The department may authorize an entity described by
2830 Section 521.165, including a driver education school described by
2931 Section 521.1655, to issue a temporary receipt to a qualifying
3032 applicant who has met all requirements for a driver's license if the
3133 qualifying applicant holds a learner license issued by the
3234 department under Section 521.222.
3335 (b) A temporary receipt issued under Subsection (a) serves
3436 as temporary permission to operate a vehicle until the department
3537 provides a driver's license to the qualifying applicant.
3638 (c) The department shall develop a process for an entity
3739 under Subsection (a) to electronically transmit to the department
3840 the documents and information required by the department for the
3941 issuance of a driver's license to a qualifying applicant.
4042 (d) The department shall adopt rules to implement this
4143 section.
4244 SECTION 3. This Act takes effect September 1, 2019.
