| 11 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 14 | | SECTION 1. Section 521.165, Transportation Code, is amended |
|---|
| 13 | 15 | | by amending Subsection (e) and adding Subsection (f) to read as |
|---|
| 14 | 16 | | follows: |
|---|
| 15 | 17 | | (e) The department may authorize and set standards for an |
|---|
| 16 | 18 | | entity described by Subsection (a), including a driver education |
|---|
| 17 | 19 | | school described by Section 521.1655, to administer, and train and |
|---|
| 18 | 20 | | certify examiners to administer, the examination required by |
|---|
| 19 | 21 | | Section 521.161(b)(2). |
|---|
| 20 | 22 | | (f) An entity described by Subsection (a) may not issue a |
|---|
| 21 | 23 | | temporary receipt under Section 521.1812 to a person who has not |
|---|
| 22 | 24 | | completed and passed the training and testing conducted by the |
|---|
| 23 | 25 | | entity under this section. |

| 24 | 26 | | SECTION 2. Subchapter I, Chapter 521, Transportation Code, |
|---|
| 25 | 27 | | is amended by adding Section 521.1812 to read as follows: |
|---|
| 26 | 28 | | Sec. 521.1812. ISSUANCE OF TEMPORARY RECEIPT BY THIRD |
|---|
| 27 | 29 | | PARTY. (a) The department may authorize an entity described by |
|---|
| 28 | 30 | | Section 521.165, including a driver education school described by |
|---|
| 29 | 31 | | Section 521.1655, to issue a temporary receipt to a qualifying |
|---|
| 30 | 32 | | applicant who has met all requirements for a driver's license if the |
|---|
| 31 | 33 | | qualifying applicant holds a learner license issued by the |
|---|
| 32 | 34 | | department under Section 521.222. |
|---|
| 33 | 35 | | (b) A temporary receipt issued under Subsection (a) serves |
|---|
| 34 | 36 | | as temporary permission to operate a vehicle until the department |
|---|
| 35 | 37 | | provides a driver's license to the qualifying applicant. |
|---|
| 36 | 38 | | (c) The department shall develop a process for an entity |
|---|
| 37 | 39 | | under Subsection (a) to electronically transmit to the department |
|---|
| 38 | 40 | | the documents and information required by the department for the |
|---|
| 39 | 41 | | issuance of a driver's license to a qualifying applicant. |
|---|
| 40 | 42 | | (d) The department shall adopt rules to implement this |
|---|
| 41 | 43 | | section. |
|---|
| 42 | 44 | | SECTION 3. This Act takes effect September 1, 2019. |
|---|
