| 10 | 10 | SECTION 1. Subchapter Z, Chapter 240, Local Government | |
| 11 | 11 | Code, is amended by adding Section 240.910 to read as follows: | |
| 12 | 12 | Sec. 240.910. REGULATION OF IMPERVIOUS COVER IN CERTAIN | |
| 13 | 13 | FLOODPLAINS. The commissioners court of a county may regulate, | |
| 14 | 14 | including by adopting zoning regulations, impervious cover located | |
| 15 | 15 | in the unincorporated area of the county and in the 100-year | |
| 16 | 16 | floodplain of perennial and intermittent streams and rivers. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2019. |
