99 E IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sec. 551.143(a), Government Code, is amended to
1111 read as follows:
1212 Sec. 551.143. CIRCUMVENTION OF [CONSPIRACY TO CIRCUMVENT]
1313 CHAPTER; OFFENSE; PENALTY. (a) A member [or group of members] of a
1414 governmental body commits an offense if the member outside of a
1515 meeting knowingly engages directly or indirectly in a series of
1616 verbal or written communications with other members of the
1717 governmental body without a quorum present regarding a tacit or
1818 explicit agreement to act uniformly in sufficient number to
1919 constitute a quorum concerning: [or group of members knowingly
2020 conspires to circumvent this chapter by meeting in numbers less
2121 than a quorum for the purpose of secret deliberations in violation
2222 of this chapter.]
2323 (1) an issue within the jurisdiction of the
2424 governmental body; or
2525 (2) any public business.
2626 (b) An offense under Subsection (a) is a misdemeanor
2727 punishable by:
2828 (1) a fine of not less than $100 or more than $500;
2929 (2) confinement in the county jail for not less than
3030 one month or more than six months; or
3131 (3) both the fine and confinement.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2019.
