9 | 9 | | E IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sec. 551.143(a), Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 551.143. CIRCUMVENTION OF [CONSPIRACY TO CIRCUMVENT] |
---|
13 | 13 | | CHAPTER; OFFENSE; PENALTY. (a) A member [or group of members] of a |
---|
14 | 14 | | governmental body commits an offense if the member outside of a |
---|
15 | 15 | | meeting knowingly engages directly or indirectly in a series of |
---|
16 | 16 | | verbal or written communications with other members of the |
---|
17 | 17 | | governmental body without a quorum present regarding a tacit or |
---|
18 | 18 | | explicit agreement to act uniformly in sufficient number to |
---|
19 | 19 | | constitute a quorum concerning: [or group of members knowingly |
---|
20 | 20 | | conspires to circumvent this chapter by meeting in numbers less |
---|
21 | 21 | | than a quorum for the purpose of secret deliberations in violation |
---|
22 | 22 | | of this chapter.] |
---|
23 | 23 | | (1) an issue within the jurisdiction of the |
---|
24 | 24 | | governmental body; or |
---|
25 | 25 | | (2) any public business. |
---|
26 | 26 | | (b) An offense under Subsection (a) is a misdemeanor |
---|
27 | 27 | | punishable by: |
---|
28 | 28 | | (1) a fine of not less than $100 or more than $500; |
---|
29 | 29 | | (2) confinement in the county jail for not less than |
---|
30 | 30 | | one month or more than six months; or |
---|
31 | 31 | | (3) both the fine and confinement. |
---|
32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2019. |
