55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to modification of an application for a place on the
88 ballot.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 141.032, Election Code, is amended by
1111 amending Subsection (g) and adding Subsection (h) to read as
1212 follows:
1313 (g) Except as provided by Subsection (h), an application
1414 filed under Section 141.031 may not be supplemented, modified, or
1515 amended on or after the date it is received by the authority with
1616 whom it is required to be filed [After the filing deadline:
1717 [(1) a candidate may not amend an application filed
1818 under Section 141.031; and
1919 [(2) the authority with whom the application is filed
2020 may not accept an amendment to an application filed under Section
2121 141.031].
2222 (h) A candidate may withdraw the candidate's application
2323 filed under Section 141.031 and any submitted petition and refile
2424 an amended application before the filing deadline.
2525 SECTION 2. Section 141.062, Election Code, is amended by
2626 amending Subsection (c) and adding Subsection (d) to read as
2727 follows:
2828 (c) Except as provided by Subsection (d), a petition may not
2929 be supplemented, modified, or amended on or after the date it is
3030 received by the authority with whom it is required to be filed
3131 [After the filing deadline:
3232 [(1) a candidate may not amend a petition in lieu of a
3333 filing fee submitted with the candidate's application; and
3434 [(2) the authority with whom the application is filed
3535 may not accept an amendment to a petition in lieu of a filing fee
3636 submitted with the candidate's application].
3737 (d) A candidate may withdraw the candidate's petition and
3838 application filed under Section 141.031 and refile an amended
3939 petition before the filing deadline.
4040 SECTION 3. The change in law made by this Act applies to an
4141 application for a place on the ballot filed on or after the
4242 effective date of this Act. An application for a place on the
4343 ballot filed before the effective date of this Act is covered by the
4444 law in effect on the date the application was filed, and the former
4545 law is continued in effect for that purpose.
4646 SECTION 4. This Act takes effect September 1, 2019.
