6	6	AN ACT
7	7	relating to fees collected by a justice court; increasing a fee.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 118.121, Local Government Code, is
10	10	amended to read as follows:
11	11	Sec. 118.121. FEE SCHEDULE. A justice of the peace shall
12	12	collect the following fees for services rendered to any person:
13	13	(1) Services rendered before judgment (Sec. 118.122)
14	14	[:
15	15	[(A) Justice court]$50.00 [$25.00
16	16	[(B) Small claims court$25.00]
17	17	(2) Services rendered after judgment (Sec. 118.123):
18	18	(A) Transcript$10.00
19	19	(B) Abstract of judgment$5.00
20	20	(C) Execution, order of sale, writ of
21	21	restitution, or other writ or process$5.00 per page
22	22	Certified copy of court papers$2.00 for
23	23	first page
24	24	$0.25 for each additional page
25	25	Issuing other document
26	26	(no return required)$1.00 for
27	27	first page
28	28	$0.25 for each additional page
29	29	SECTION 2. Section 118.122(a), Local Government Code, is
30	30	amended to read as follows:
31	31	(a) The fee for "Services rendered before judgment" under
32	32	Section 118.121(1) is for all required filings of documents,
33	33	including the filing of a counterclaim, and all other processes and
34	34	procedures in a civil matter in a justice court [or small claims
35	35	court].
36	36	SECTION 3. Section 118.123(a), Local Government Code, is
37	37	amended to read as follows:
38	38	(a) The fee for "Services rendered after judgment" under
39	39	Section 118.121(2) applies to a civil matter in a justice court [or
40	40	small claims court].
41	41	SECTION 4. Section 118.1235, Local Government Code, is
42	42	amended to read as follows:
43	43	Sec. 118.1235. FEE FOR CERTIFIED COPY. The fee for
44	44	"Certified copy of court papers" under Section 118.121(2) is for
45	45	issuing a certified copy of a paper filed in a justice court [or a
46	46	small claims court]. The fee must be paid at the time the order is
47	47	placed.
48	48	SECTION 5. The heading to Subchapter H, Chapter 101,
49	49	Government Code, is amended to read as follows:
50	50	SUBCHAPTER H. JUSTICE COURTS [AND SMALL CLAIMS COURTS]
51	51	SECTION 6. The heading to Section 101.141, Government Code,
52	52	is amended to read as follows:
53	53	Sec. 101.141. JUSTICE COURT [AND SMALL CLAIMS COURT] FEES
54	54	AND COSTS COLLECTED BY CLERK.
55	55	SECTION 7. The heading to Section 101.151, Government Code,
56	56	is amended to read as follows:
57	57	Sec. 101.151. JUSTICE COURT [AND SMALL CLAIMS COURT] FEES
58	58	COLLECTED BY JUSTICE OF THE PEACE.
59	59	SECTION 8. Section 101.151(a), Government Code, is amended
60	60	to read as follows:
61	61	(a) A justice of the peace shall collect the following fees
62	62	under the Local Government Code:
63	63	(1) services rendered before judgment (Secs. 118.121
64	64	and 118.122, Local Government Code) [:
65	65	[(A) justice court (Sec. 118.121, Local
66	66	Government Code)] . . . $50 [$25; and
67	67	[(B) small claims court (Sec. 118.121, Local

84	84	SECTION 9. The changes in law made by this Act apply only to
85	85	a cause of action filed on or after the effective date of this Act.
86	86	A cause of action filed before the effective date of this Act is
87	87	governed by the law in effect immediately before the effective date
88	88	of this Act, and that law is continued in effect for that purpose.
89	89	SECTION 10. This Act takes effect September 1, 2019.
