86 AN ACT
9- relating to educational programs provided by the Windham School
10- District in the Texas Department of Criminal Justice for certain
11- inmates.
7+ relating to educational requirements for inmates who are younger
8+ than 18 years of age.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Section 19.005, Education Code, is amended by
14- adding Subsections (a-1) and (c) to read as follows:
15- (a-1) Unless providing the educational program poses a
16- significant safety threat to instructors, the Windham School
17- District shall provide an educational program that includes the
18- required curriculum under Section 28.002 to each person confined or
19- imprisoned in the department who is not a high school graduate and
20- is:
21- (1) younger than 19 years of age; or
22- (2) if the person would be eligible to receive special
23- education services under Subchapter A, Chapter 29, younger than 22
24- years of age.
10+ SECTION 1. Chapter 493, Government Code, is amended by
11+ adding Section 493.032 to read as follows:
12+ Sec. 493.032. EDUCATIONAL REQUIREMENTS FOR CERTAIN
13+ INMATES. (a) The department shall provide a course of instruction
14+ that includes the required curriculum provided by Section 28.002,
15+ Education Code, to each inmate who is younger than 18 years of age
16+ unless providing the instruction poses a significant safety threat
17+ to instructors. The Texas Education Agency shall collaborate with
18+ the department in providing necessary materials for instruction.
19+ (b) The department may enter into an agreement with the
20+ Windham School District for purposes of complying with this
21+ section.
2522 (c) The board may adopt rules as necessary to implement this

2724 SECTION 2. This Act takes effect September 1, 2019.
