| 10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 13 | | SECTION 1. Section 46.035(a), Penal Code, is amended to |
|---|
| 12 | 14 | | read as follows: |
|---|
| 13 | 15 | | (a) A license holder commits an offense if the license |
|---|
| 14 | 16 | | holder carries a handgun on or about the license holder's person |
|---|
| 15 | 17 | | under the authority of Subchapter H, Chapter 411, Government Code, |
|---|
| 16 | 18 | | and intentionally displays the handgun in plain view of another |
|---|
| 17 | 19 | | person in a public place. It is an exception to the application of |
|---|
| 18 | 20 | | this subsection that the handgun was partially or wholly visible |
|---|
| 19 | 21 | | but was: |
|---|
| 20 | 22 | | (1) carried in a shoulder or belt holster by the |
|---|
| 21 | 23 | | license holder; or |
|---|
| 22 | 24 | | (2) in a holster, and the handgun and the license |
|---|
| 23 | 25 | | holder were in a motor vehicle. |

| 24 | 26 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 27 | | to an offense committed on or after January 1, 2020. An offense |
|---|
| 26 | 28 | | committed before January 1, 2020, is governed by the law in effect |
|---|
| 27 | 29 | | on the date the offense was committed, and the former law is |
|---|
| 28 | 30 | | continued in effect for that purpose. For purposes of this section, |
|---|
| 29 | 31 | | an offense was committed before January 1, 2020, if any element of |
|---|
| 30 | 32 | | the offense occurred before that date. |
|---|
| 31 | 33 | | SECTION 3. This Act takes effect September 1, 2019. |
