8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Section 30.05, Penal Code, is amended by adding |
---|
10 | 16 | | Subsections (f-1), (f-2), and (f-3) to read as follows: |
---|
11 | 17 | | (f-1) It is a defense to prosecution under this section |
---|
12 | 18 | | that: |
---|
13 | 19 | | (1) the basis on which entry on the property was |
---|
14 | 20 | | forbidden is that entry with a firearm or firearm ammunition was |
---|
15 | 21 | | forbidden; |
---|
16 | 22 | | (2) the actor is: |
---|
17 | 23 | | (A) an owner of an apartment in a condominium |
---|
18 | 24 | | regime governed by Chapter 81, Property Code; |
---|
19 | 25 | | (B) an owner of a condominium unit governed by |
---|
20 | 26 | | Chapter 82, Property Code; |
---|
21 | 27 | | (C) a tenant or guest of an owner described by |
---|
22 | 28 | | Paragraph (A) or (B); or |
---|
23 | 29 | | (D) a guest of a tenant of an owner described by |
---|
24 | 30 | | Paragraph (A) or (B); |
---|
25 | 31 | | (3) the actor: |
---|
26 | 32 | | (A) carries or stores a firearm or firearm |
---|
27 | 33 | | ammunition in the condominium apartment or unit owner's apartment |
---|
28 | 34 | | or unit; |
---|
29 | 35 | | (B) carries a firearm or firearm ammunition |
---|
30 | 36 | | directly en route to or from the condominium apartment or unit |
---|
31 | 37 | | owner's apartment or unit; |
---|
32 | 38 | | (C) carries a firearm or firearm ammunition |
---|
33 | 39 | | directly en route to or from the actor's vehicle located in a |
---|
34 | 40 | | parking area provided for residents or guests of the condominium |
---|
35 | 41 | | property; or |
---|
36 | 42 | | (D) carries or stores a firearm or firearm |
---|
37 | 43 | | ammunition in the actor's vehicle located in a parking area |
---|
38 | 44 | | provided for residents or guests of the condominium property; and |
---|
39 | 45 | | (4) the actor is not otherwise prohibited by law from |
---|
40 | 46 | | possessing a firearm or firearm ammunition. |
---|
41 | 47 | | (f-2) It is a defense to prosecution under this section |
---|

43 | 49 | | (1) the basis on which entry on a leased premises |

44 | 50 | | governed by Chapter 92, Property Code, was forbidden is that entry |
---|
45 | 51 | | with a firearm or firearm ammunition was forbidden; |
---|
46 | 52 | | (2) the actor is a tenant of the leased premises or the |
---|
47 | 53 | | tenant's guest; |
---|
48 | 54 | | (3) the actor: |
---|
49 | 55 | | (A) carries or stores a firearm or firearm |
---|
50 | 56 | | ammunition in the tenant's rental unit; |
---|
51 | 57 | | (B) carries a firearm or firearm ammunition |
---|
52 | 58 | | directly en route to or from the tenant's rental unit; |
---|
53 | 59 | | (C) carries a firearm or firearm ammunition |
---|
54 | 60 | | directly en route to or from the actor's vehicle located in a |
---|
55 | 61 | | parking area provided for tenants or guests by the landlord of the |
---|
56 | 62 | | leased premises; or |
---|
57 | 63 | | (D) carries or stores a firearm or firearm |
---|
58 | 64 | | ammunition in the actor's vehicle located in a parking area |
---|
59 | 65 | | provided for tenants or guests by the landlord of the leased |
---|

61 | 67 | | (4) the actor is not otherwise prohibited by law from |

62 | 68 | | possessing a firearm or firearm ammunition. |

63 | 69 | | (f-3) It is a defense to prosecution under this section |

85 | 91 | | SECTION 2. Section 30.06, Penal Code, is amended by adding |
---|
86 | 92 | | Subsections (e-1), (e-2), and (e-3) to read as follows: |

119 | 125 | | from the license holder's vehicle located in a parking area |
---|
120 | 126 | | provided for tenants or guests by the landlord of the leased |

122 | 128 | | (D) carries or stores a handgun in the license |
---|
123 | 129 | | holder's vehicle located in a parking area provided for tenants or |

142 | 148 | | SECTION 3. Section 30.07, Penal Code, is amended by adding |

214 | 220 | | (2) in a vehicle located in a parking area provided for |

215 | 221 | | the residents or guests of the condominium property; or |

216 | 222 | | (3) in other common element locations as necessary to: |

217 | 223 | | (A) enter or exit the condominium property; |

218 | 224 | | (B) enter or exit the condominium unit owner's |

---|
220 | 226 | | (C) enter or exit a vehicle on the condominium |

265 | 271 | | the effective date of this Act. An offense committed before the |

266 | 272 | | effective date of this Act is governed by the law in effect on the |
---|
267 | 273 | | date the offense was committed, and the former law is continued in |
---|
268 | 274 | | effect for that purpose. For purposes of this section, an offense |
---|
269 | 275 | | was committed before the effective date of this Act if any element |

270 | 276 | | of the offense occurred before that date. |

271 | 277 | | SECTION 9. Sections 92.026 and 94.257, Property Code, as |
---|
272 | 278 | | added by this Act, do not affect the enforceability of a provision |
---|
273 | 279 | | in a lease agreement entered into or renewed before the effective |
---|
274 | 280 | | date of this Act. |

275 | 281 | | SECTION 10. This Act takes effect September 1, 2019. |
