410 AN ACT
511 relating to the carrying, storage, or possession of a firearm or
612 firearm ammunition by certain persons on certain residential or
713 commercial property.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 30.05, Penal Code, is amended by adding
1016 Subsections (f-1), (f-2), and (f-3) to read as follows:
1117 (f-1) It is a defense to prosecution under this section
1218 that:
1319 (1) the basis on which entry on the property was
1420 forbidden is that entry with a firearm or firearm ammunition was
1521 forbidden;
1622 (2) the actor is:
1723 (A) an owner of an apartment in a condominium
1824 regime governed by Chapter 81, Property Code;
1925 (B) an owner of a condominium unit governed by
2026 Chapter 82, Property Code;
2127 (C) a tenant or guest of an owner described by
2228 Paragraph (A) or (B); or
2329 (D) a guest of a tenant of an owner described by
2430 Paragraph (A) or (B);
2531 (3) the actor:
2632 (A) carries or stores a firearm or firearm
2733 ammunition in the condominium apartment or unit owner's apartment
2834 or unit;
2935 (B) carries a firearm or firearm ammunition
3036 directly en route to or from the condominium apartment or unit
3137 owner's apartment or unit;
3238 (C) carries a firearm or firearm ammunition
3339 directly en route to or from the actor's vehicle located in a
3440 parking area provided for residents or guests of the condominium
3541 property; or
3642 (D) carries or stores a firearm or firearm
3743 ammunition in the actor's vehicle located in a parking area
3844 provided for residents or guests of the condominium property; and
3945 (4) the actor is not otherwise prohibited by law from
4046 possessing a firearm or firearm ammunition.
4147 (f-2) It is a defense to prosecution under this section
4248 that:
4349 (1) the basis on which entry on a leased premises
4450 governed by Chapter 92, Property Code, was forbidden is that entry
4551 with a firearm or firearm ammunition was forbidden;
4652 (2) the actor is a tenant of the leased premises or the
4753 tenant's guest;
4854 (3) the actor:
4955 (A) carries or stores a firearm or firearm
5056 ammunition in the tenant's rental unit;
5157 (B) carries a firearm or firearm ammunition
5258 directly en route to or from the tenant's rental unit;
5359 (C) carries a firearm or firearm ammunition
5460 directly en route to or from the actor's vehicle located in a
5561 parking area provided for tenants or guests by the landlord of the
5662 leased premises; or
5763 (D) carries or stores a firearm or firearm
5864 ammunition in the actor's vehicle located in a parking area
5965 provided for tenants or guests by the landlord of the leased
6066 premises; and
6167 (4) the actor is not otherwise prohibited by law from
6268 possessing a firearm or firearm ammunition.
6369 (f-3) It is a defense to prosecution under this section
6470 that:
6571 (1) the basis on which entry on a leased premises
6672 governed by Chapter 94, Property Code, was forbidden is that entry
6773 with a firearm or firearm ammunition was forbidden;
6874 (2) the actor is a tenant of a manufactured home lot or
6975 the tenant's guest;
7076 (3) the actor:
7177 (A) carries or stores a firearm or firearm
7278 ammunition in the tenant's manufactured home;
7379 (B) carries a firearm or firearm ammunition
7480 directly en route to or from the tenant's manufactured home;
7581 (C) carries a firearm or firearm ammunition
7682 directly en route to or from the actor's vehicle located in a
7783 parking area provided for tenants or tenants' guests by the
7884 landlord of the leased premises; or
7985 (D) carries or stores a firearm or firearm
8086 ammunition in the actor's vehicle located in a parking area
8187 provided for tenants or tenants' guests by the landlord of the
8288 leased premises; and
8389 (4) the actor is not otherwise prohibited by law from
8490 possessing a firearm or firearm ammunition.
8591 SECTION 2. Section 30.06, Penal Code, is amended by adding
8692 Subsections (e-1), (e-2), and (e-3) to read as follows:
8793 (e-1) It is a defense to prosecution under this section
8894 that:
8995 (1) the license holder is:
9096 (A) an owner of an apartment in a condominium
9197 regime governed by Chapter 81, Property Code;
9298 (B) an owner of a condominium unit governed by
9399 Chapter 82, Property Code;
94100 (C) a tenant or guest of an owner described by
95101 Paragraph (A) or (B); or
96102 (D) a guest of a tenant of an owner described by
97103 Paragraph (A) or (B); and
98104 (2) the license holder:
99105 (A) carries or stores a handgun in the
100106 condominium apartment or unit owner's apartment or unit;
101107 (B) carries a handgun directly en route to or
102108 from the condominium apartment or unit owner's apartment or unit;
103109 (C) carries a handgun directly en route to or
104110 from the license holder's vehicle located in a parking area
105111 provided for residents or guests of the condominium property; or
106112 (D) carries or stores a handgun in the license
107113 holder's vehicle located in a parking area provided for residents
108114 or guests of the condominium property.
109115 (e-2) It is a defense to prosecution under this section
110116 that:
111117 (1) the license holder is a tenant of a leased premises
112118 governed by Chapter 92, Property Code, or the tenant's guest; and
113119 (2) the license holder:
114120 (A) carries or stores a handgun in the tenant's
115121 rental unit;
116122 (B) carries a handgun directly en route to or
117123 from the tenant's rental unit;
118124 (C) carries a handgun directly en route to or
119125 from the license holder's vehicle located in a parking area
120126 provided for tenants or guests by the landlord of the leased
121127 premises; or
122128 (D) carries or stores a handgun in the license
123129 holder's vehicle located in a parking area provided for tenants or
124130 guests by the landlord of the leased premises.
125131 (e-3) It is a defense to prosecution under this section
126132 that:
127133 (1) the license holder is a tenant of a manufactured
128134 home lot governed by Chapter 94, Property Code, or the tenant's
129135 guest; and
130136 (2) the license holder:
131137 (A) carries or stores a handgun in the tenant's
132138 manufactured home;
133139 (B) carries a handgun directly en route to or
134140 from the tenant's manufactured home;
135141 (C) carries a handgun directly en route to or
136142 from the license holder's vehicle located in a parking area
137143 provided for tenants or tenants' guests by the landlord of the
138144 leased premises; or
139145 (D) carries or stores a handgun in the license
140146 holder's vehicle located in a parking area provided for tenants or
141147 tenants' guests by the landlord of the leased premises.
142148 SECTION 3. Section 30.07, Penal Code, is amended by adding
143149 Subsections (e-1), (e-2), and (e-3) to read as follows:
144150 (e-1) It is a defense to prosecution under this section
145151 that:
146152 (1) the license holder is:
147153 (A) an owner of an apartment in a condominium
148154 regime governed by Chapter 81, Property Code;
149155 (B) an owner of a condominium unit governed by
150156 Chapter 82, Property Code;
151157 (C) a tenant or guest of an owner described by
152158 Paragraph (A) or (B); or
153159 (D) a guest of a tenant of an owner described by
154160 Paragraph (A) or (B); and
155161 (2) the license holder:
156162 (A) carries or stores a handgun in the
157163 condominium apartment or unit owner's apartment or unit;
158164 (B) carries a handgun directly en route to or
159165 from the condominium apartment or unit owner's apartment or unit;
160166 (C) carries a handgun directly en route to or
161167 from the license holder's vehicle located in a parking area
162168 provided for residents or guests of the condominium property; or
163169 (D) carries or stores a handgun in the license
164170 holder's vehicle located in a parking area provided for residents
165171 or guests of the condominium property.
166172 (e-2) It is a defense to prosecution under this section
167173 that:
168174 (1) the license holder is a tenant of a leased premises
169175 governed by Chapter 92, Property Code, or the tenant's guest; and
170176 (2) the license holder:
171177 (A) carries or stores a handgun in the tenant's
172178 rental unit;
173179 (B) carries a handgun directly en route to or
174180 from the tenant's rental unit;
175181 (C) carries a handgun directly en route to or
176182 from the license holder's vehicle located in a parking area
177183 provided for tenants or guests by the landlord of the leased
178184 premises; or
179185 (D) carries or stores a handgun in the license
180186 holder's vehicle located in a parking area provided for tenants or
181187 guests by the landlord of the leased premises.
182188 (e-3) It is a defense to prosecution under this section
183189 that:
184190 (1) the license holder is a tenant of a manufactured
185191 home lot governed by Chapter 94, Property Code, or the tenant's
186192 guest; and
187193 (2) the license holder:
188194 (A) carries or stores a handgun in the tenant's
189195 manufactured home;
190196 (B) carries a handgun directly en route to or
191197 from the tenant's manufactured home;
192198 (C) carries a handgun directly en route to or
193199 from the license holder's vehicle located in a parking area
194200 provided for tenants or tenants' guests by the landlord of the
195201 leased premises; or
196202 (D) carries or stores a handgun in the license
197203 holder's vehicle located in a parking area provided for tenants or
198204 tenants' guests by the landlord of the leased premises.
199205 SECTION 4. Section 82.002, Property Code, is amended by
200206 adding Subsection (c-1) to read as follows:
201207 (c-1) Section 82.121 applies to a condominium for which the
202208 declaration was recorded before January 1, 1994.
203209 SECTION 5. Subchapter C, Chapter 82, Property Code, is
204210 amended by adding Section 82.121 to read as follows:
205211 Sec. 82.121. POSSESSION OF FIREARM OR FIREARM AMMUNITION ON
206212 CONDOMINIUM PROPERTY. (a) Unless possession of a firearm or
207213 firearm ammunition on condominium property is prohibited by state
208214 or federal law, a condominium unit owner, or a tenant or guest of a
209215 condominium unit owner, or a guest of a tenant of a condominium unit
210216 owner may not be prohibited from lawfully possessing, carrying,
211217 transporting, or storing a firearm, any part of a firearm, or
212218 firearm ammunition:
213219 (1) in the condominium unit owner's unit;
214220 (2) in a vehicle located in a parking area provided for
215221 the residents or guests of the condominium property; or
216222 (3) in other common element locations as necessary to:
217223 (A) enter or exit the condominium property;
218224 (B) enter or exit the condominium unit owner's
219225 unit; or
220226 (C) enter or exit a vehicle on the condominium
221227 property or located in a parking area provided for residents or
222228 guests of the condominium property.
223229 (b) This section applies notwithstanding any provision of a
224230 dedicatory instrument to the contrary and regardless of the date of
225231 the provision's adoption.
226232 SECTION 6. Subchapter A, Chapter 92, Property Code, is
227233 amended by adding Section 92.026 to read as follows:
228234 Sec. 92.026. POSSESSION OF FIREARMS OR FIREARM AMMUNITION
229235 ON LEASED PREMISES. Unless possession of a firearm or firearm
230236 ammunition on a landlord's property is prohibited by state or
231237 federal law, a landlord may not prohibit a tenant or a tenant's
232238 guest from lawfully possessing, carrying, transporting, or storing
233239 a firearm, any part of a firearm, or firearm ammunition:
234240 (1) in the tenant's rental unit;
235241 (2) in a vehicle located in a parking area provided for
236242 tenants or guests by the landlord of the leased premises; or
237243 (3) in other locations controlled by the landlord as
238244 necessary to:
239245 (A) enter or exit the tenant's rental unit;
240246 (B) enter or exit the leased premises; or
241247 (C) enter or exit a vehicle on the leased
242248 premises or located in a parking area provided by the landlord for
243249 tenants or guests.
244250 SECTION 7. Subchapter F, Chapter 94, Property Code, is
245251 amended by adding Section 94.257 to read as follows:
246252 Sec. 94.257. POSSESSION OF FIREARM OR FIREARM AMMUNITION ON
247253 LEASED PREMISES. Unless possession of a firearm or firearm
248254 ammunition on a landlord's property is prohibited by state or
249255 federal law, a landlord may not prohibit a tenant or a tenant's
250256 guest from lawfully possessing, carrying, transporting, or storing
251257 a firearm, any part of a firearm, or firearm ammunition:
252258 (1) in the tenant's manufactured home;
253259 (2) in a vehicle located in a parking area provided for
254260 tenants or tenants' guests by the landlord of the leased premises;
255261 or
256262 (3) in other locations controlled by the landlord as
257263 necessary to:
258264 (A) enter or exit the tenant's manufactured home;
259265 (B) enter or exit the leased premises; or
260266 (C) enter or exit a vehicle on the leased
261267 premises or located in a parking area provided by the landlord for
262268 tenants or tenants' guests.
263269 SECTION 8. Sections 30.05, 30.06, and 30.07, Penal Code, as
264270 amended by this Act, apply only to an offense committed on or after
265271 the effective date of this Act. An offense committed before the
266272 effective date of this Act is governed by the law in effect on the
267273 date the offense was committed, and the former law is continued in
268274 effect for that purpose. For purposes of this section, an offense
269275 was committed before the effective date of this Act if any element
270276 of the offense occurred before that date.
271277 SECTION 9. Sections 92.026 and 94.257, Property Code, as
272278 added by this Act, do not affect the enforceability of a provision
273279 in a lease agreement entered into or renewed before the effective
274280 date of this Act.
275281 SECTION 10. This Act takes effect September 1, 2019.
