4	10		AN ACT
5	11		relating to emergency warning systems operated by municipalities
6	12		and counties.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter E, Chapter 418, Government Code, is
9	15		amended by adding Section 418.1103 to read as follows:
10	16		Sec. 418.1103. LOCAL EMERGENCY WARNING SYSTEM. (a) In this
11	17		section, "contact information" means an individual's telephone
12	18		number, mobile telephone number, physical address, or e-mail
13	19		address.
14	20		(b) For purposes of operating an emergency warning system
15	21		for residents of a political subdivision, the political subdivision
16	22		may contract with the department for disclosure by the department
17	23		of the contact information of a political subdivision resident who
18	24		consents to the disclosure for the purpose of participating in the
19	25		system.
20	26		(c) A participant in an emergency warning system described
21	27		by Subsection (b) may request removal from the system by submitting
22	28		a written request, including a text message from a cellular
23	29		telephone or other wireless communication device, for removal to
24	30		the applicable political subdivision. On receipt of the request,
25	31		the applicable political subdivision shall remove the
26	32		participant's contact information from the system and cease issuing
27	33		emergency warnings to the former participant through the system.
28	34		SECTION 2. Subchapter A, Chapter 521, Transportation Code,
29	35		is amended by adding Section 521.013 to read as follows:
30	36		Sec. 521.013. VOLUNTARY PARTICIPATION IN LOCAL EMERGENCY
31	37		WARNING SYSTEM. (a) In this section, "contact information" has the
32	38		meaning assigned by Section 418.1103, Government Code.
33	39		(b) When a person applies for an original or renewal
34	40		driver's license under this chapter, the person may consent to:
35	41		(1) participate in an emergency warning system
36	42		described by Section 418.1103, Government Code; and
37	43		(2) the disclosure by the department of the person's
38	44		contact information to the municipality or county, or both, in
39	45		which the person resides for the purpose of participating in an
40	46		emergency warning system operated by the municipality or county.
41	47		(c) The department shall include space on each application
42	48		for an original or renewal driver's license that allows a person
43	49		applying for an original or renewal driver's license to indicate
44	50		whether the person consents to participate in an emergency warning
45	51		system operated by the municipality or county, or both, in which the
46	52		person resides and consents to disclosure by the department of the
47	53		person's contact information to the municipality or county or both.
48	54		(d) The department shall disclose a person's contact
49	55		information to a municipality or county for participation in an
50	56		emergency warning system if:
51	57		(1) the person indicates the person's consent to
52	58		participate in an emergency warning system and to the disclosure of
53	59		the person's contact information under Subsection (b); and
54	60		(2) the applicable municipality or county:
55	61		(A) operates an emergency warning system; and
56	62		(B) has contracted with the department for the
57	63		disclosure of the person's contact information under Section
58	64		418.1103, Government Code.
59	65		(e) Contact information obtained by a municipality or
60	66		county under this section may not be used or disclosed for any
61	67		purpose other than enrolling a person in an emergency warning
62	68		system and issuing warnings to the person through the system.
63	69		SECTION 3. This Act takes effect September 1, 2019.
