| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 382.067 to read as follows: |
|---|
| 12 | 12 | | Sec. 382.067. AGGREGATE PRODUCTION OPERATION ROAD LOAD |
|---|
| 13 | 13 | | LIMITS. (a) In this section, "aggregate production operation" has |
|---|
| 14 | 14 | | the meaning assigned by Section 28A.001, Water Code. |
|---|
| 15 | 15 | | (b) The commission may not issue an air permit under Section |
|---|
| 16 | 16 | | 382.051 to an aggregate production operation unless the operation |
|---|
| 17 | 17 | | demonstrates that the Texas Department of Transportation and the |
|---|
| 18 | 18 | | commissioners court of the county in which the proposed aggregate |
|---|
| 19 | 19 | | production operation is located have established load limits under |
|---|
| 20 | 20 | | Sections 621.102 and 621.301, Transportation Code, on each road on |
|---|
| 21 | 21 | | which the operation expects to operate vehicles. |
|---|
| 22 | 22 | | (c) An aggregate production operation may petition to the |
|---|
| 23 | 23 | | Texas Department of Transportation for a technical review of a load |
|---|
| 24 | 24 | | limit established by the commissioners court under Subsection (b). |
|---|
| 25 | 25 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 26 | 26 | | an application for a permit that is filed with the Texas Commission |
|---|
| 27 | 27 | | on Environmental Quality on or after the effective date of this Act. |
|---|
| 28 | 28 | | An application for a permit filed before the effective date of this |
|---|
| 29 | 29 | | Act is governed by the law in effect on the date of filing, and that |
|---|
| 30 | 30 | | law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2019. |
