| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Subchapter C, Chapter 364, Health and Safety |
|---|
| 9 | 16 | | Code, is amended by adding Section 364.0341 to read as follows: |
|---|
| 10 | 17 | | Sec. 364.0341. SOLID WASTE DISPOSAL SERVICES IN |
|---|
| 11 | 18 | | EXTRATERRITORIAL JURISDICTION OF CERTAIN MUNICIPALITIES. (a) This |
|---|
| 12 | 19 | | section applies only to a municipality wholly or partly located in a |
|---|
| 13 | 20 | | county with a population of more than 54,000 and less than 54,500. |
|---|
| 14 | 21 | | (b) Notwithstanding Sections 364.011(a) and 364.034(a), a |
|---|
| 15 | 22 | | county may offer, require the use of, and charge a fee for solid |
|---|
| 16 | 23 | | waste disposal services in the extraterritorial jurisdiction of a |
|---|
| 17 | 24 | | municipality. |
|---|
| 18 | 25 | | (c) A municipality may not provide solid waste disposal |
|---|
| 19 | 26 | | services or charge a fee for those services in the municipality's |
|---|
| 20 | 27 | | extraterritorial jurisdiction if the county provides those |
|---|
| 21 | 28 | | services under Subsection (b). |

| 22 | 29 | | SECTION 2. This Act takes effect September 1, 2019. |
