| 8 | 8 | | Higher Education Coordinating Board. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 61.0512(h), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (h) In approving [a degree or certificate program under this |
|---|
| 13 | 13 | | section, the board: |
|---|
| 14 | 14 | | [(1) for a doctoral program, may not consider |
|---|
| 15 | 15 | | undergraduate graduation or persistence rates; and |
|---|
| 16 | 16 | | [(2) for] a baccalaureate degree program proposed to |
|---|
| 17 | 17 | | be offered by a public junior college previously authorized by the |
|---|
| 18 | 18 | | board to offer baccalaureate degree programs under a pilot project |
|---|
| 19 | 19 | | described by Section 130.303(a), as added by Chapter 766 (S.B. |
|---|
| 20 | 20 | | 2118), Acts of the 85th Legislature, Regular Session, 2017, the |
|---|
| 21 | 21 | | board [130.0012]: |
|---|
| 22 | 22 | | (1) [(A)] shall approve the degree program within 60 |
|---|
| 23 | 23 | | days after the date the board receives notice of the degree program |
|---|
| 24 | 24 | | if the degree program: |
|---|
| 25 | 25 | | (A) [(i)] is approved by the governing board of |
|---|
| 26 | 26 | | the junior college district; and |
|---|
| 27 | 27 | | (B) [(ii)] is not an engineering program; and |
|---|
| 28 | 28 | | (2) [(B)] is considered to have approved the degree |
|---|
| 29 | 29 | | program after the date described by Subdivision (1) [Paragraph (A)] |
|---|
| 30 | 30 | | if the conditions of that subdivision [paragraph] are satisfied. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2019. |
