| 7 | 7 | | relating to damage to a motor vehicle caused by the vehicle being |

| 8 | 8 | | flooded. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 501.091, Transportation Code, is amended |
|---|
| 11 | 11 | | by adding Subdivision (4-a) to read as follows: |
|---|
| 12 | 12 | | (4-a) "Flooded" means, with respect to damage to a |
|---|
| 13 | 13 | | motor vehicle, submerged in water that: |
|---|
| 14 | 14 | | (A) rises higher than a doorsill of the vehicle, |
|---|
| 15 | 15 | | enters the vehicle's passenger, trunk, or engine compartment, and |
|---|
| 16 | 16 | | comes into contact with the vehicle's electrical system; or |
|---|
| 17 | 17 | | (B) causes an insurance company to pay a claim on |
|---|
| 18 | 18 | | and take possession of the vehicle. |

| 19 | 19 | | SECTION 2. Section 501.09112(d), Transportation Code, is |
|---|
| 20 | 20 | | amended to read as follows: |
|---|
| 21 | 21 | | (d) A salvage vehicle title or a salvage record of title for |
|---|
| 22 | 22 | | a vehicle that is a salvage motor vehicle because of damage caused |
|---|
| 23 | 23 | | exclusively by the vehicle being flooded [flood] must bear a |
|---|
| 24 | 24 | | notation that the department considers appropriate. If the title |
|---|
| 25 | 25 | | for a motor vehicle reflects the notation required by this |
|---|
| 26 | 26 | | subsection, the owner may sell, transfer, or release the motor |
|---|
| 27 | 27 | | vehicle only as provided by this subchapter. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2019. |
