4	11		AN ACT
5	12		relating to investigations of abuse, neglect, or exploitation of
6	13		home and community support services agencies providing inpatient
7	14		hospice services.
8	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	16		SECTION 1. Subchapter A, Chapter 142, Health and Safety
10	17		Code, is amended by adding Section 142.0095 to read as follows:
11	18		Sec. 142.0095. INVESTIGATIONS OF HOME AND COMMUNITY SUPPORT
12	19		SERVICES AGENCIES PROVIDING HOSPICE SERVICES. The commission or
13	20		its authorized representative shall investigate an allegation of
14	21		abuse, neglect, or exploitation of a client of any age of a home and
15	22		community support services agency if:
16	23		(1) the abuse, neglect, or exploitation occurs when
17	24		the client is receiving inpatient hospice services; and
18	25		(2) the alleged perpetrator of the abuse, neglect, or
19	26		exploitation is an employee, volunteer, contractor, or
20	27		subcontractor of the home and community support services agency.
21	28		SECTION 2. Section 142.0095, Health and Safety Code, as
22	29		added by this Act, applies only to an allegation made on or after
23	30		the effective date of this Act.
24	31		SECTION 3. This Act takes effect immediately if it receives
25	32		a vote of two-thirds of all the members elected to each house, as
26	33		provided by Section 39, Article III, Texas Constitution. If this
27	34		Act does not receive the vote necessary for immediate effect, this
28	35		Act takes effect September 1, 2019.
