66 AN ACT
77 relating to a closure plan for the Austin State Supported Living
88 Center.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. CLOSURE PLAN. (a) The Health and Human Services
1111 Commission, in collaboration with stakeholders, shall establish a
1212 closure plan for the Austin State Supported Living Center. The plan
1313 must provide for closure of the facility and operations of the
1414 Austin State Supported Living Center not later than August 31,
1515 2024.
1616 (b) The Health and Human Services Commission shall
1717 transition as many individuals to the community as possible, while
1818 maintaining respect for resident choice. The closure plan must
1919 provide procedures to transition individuals using all available
2020 placements, including access to placement under a home and
2121 community-based services (HCS) waiver program, intermediate care
2222 facility, or other state supported living center. The Health and
2323 Human Services Commission must involve in the planning process
2424 community providers, residents, individuals with an intellectual
2525 or developmental disability who are receiving home and
2626 community-based (HCS) waiver services, and other stakeholders.
2727 (c) The Health and Human Services Commission shall develop a
2828 plan, in collaboration with a representative of the Austin State
2929 Supported Living Center employees, to transition current employees
3030 to other employment. The Health and Human Services Commission may
3131 award one-time retention bonuses to each direct support
3232 professional, qualified intellectual disability professional,
3333 social worker, and case manager who agrees to continue to provide
3434 services at the Austin State Supported Living Center until the
3535 center is closed.
3636 (d) Any proceeds from the closure, including from the sale
3737 or lease of facilities or other property, may be appropriated only
3838 for services for persons with intellectual and developmental
3939 disabilities, including persons with a dual diagnosis of
4040 intellectual and developmental disabilities and mental illness.
4141 (e) Not later than August 31, 2025, the Health and Human
4242 Services Commission, in collaboration with stakeholders, shall
4343 evaluate the closure process, including how well the closure plan
4444 worked and outcomes for residents transitioned, and, if
4545 appropriate, shall develop recommended policies for future
4646 closures of other state supported living centers.
4747 SECTION 2. EXPIRATION. This Act expires August 31, 2025.
4848 SECTION 3. EFFECTIVE DATE. This Act takes effect
4949 immediately if it receives a vote of two-thirds of all the members
5050 elected to each house, as provided by Section 39, Article III, Texas
5151 Constitution. If this Act does not receive the vote necessary for
5252 immediate effect, this Act takes effect September 1, 2019.
