7 | 7 | | relating to a closure plan for the Austin State Supported Living |

8 | 8 | | Center. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. CLOSURE PLAN. (a) The Health and Human Services |
---|
11 | 11 | | Commission, in collaboration with stakeholders, shall establish a |
---|
12 | 12 | | closure plan for the Austin State Supported Living Center. The plan |
---|
13 | 13 | | must provide for closure of the facility and operations of the |
---|
14 | 14 | | Austin State Supported Living Center not later than August 31, |
---|
15 | 15 | | 2024. |
---|
16 | 16 | | (b) The Health and Human Services Commission shall |
---|
17 | 17 | | transition as many individuals to the community as possible, while |
---|
18 | 18 | | maintaining respect for resident choice. The closure plan must |
---|
19 | 19 | | provide procedures to transition individuals using all available |
---|
20 | 20 | | placements, including access to placement under a home and |
---|
21 | 21 | | community-based services (HCS) waiver program, intermediate care |
---|
22 | 22 | | facility, or other state supported living center. The Health and |
---|
23 | 23 | | Human Services Commission must involve in the planning process |
---|
24 | 24 | | community providers, residents, individuals with an intellectual |
---|
25 | 25 | | or developmental disability who are receiving home and |
---|
26 | 26 | | community-based (HCS) waiver services, and other stakeholders. |
---|
27 | 27 | | (c) The Health and Human Services Commission shall develop a |
---|
28 | 28 | | plan, in collaboration with a representative of the Austin State |
---|
29 | 29 | | Supported Living Center employees, to transition current employees |
---|
30 | 30 | | to other employment. The Health and Human Services Commission may |
---|
31 | 31 | | award one-time retention bonuses to each direct support |
---|
32 | 32 | | professional, qualified intellectual disability professional, |
---|
33 | 33 | | social worker, and case manager who agrees to continue to provide |
---|
34 | 34 | | services at the Austin State Supported Living Center until the |
---|
35 | 35 | | center is closed. |
---|
36 | 36 | | (d) Any proceeds from the closure, including from the sale |
---|
37 | 37 | | or lease of facilities or other property, may be appropriated only |
---|
38 | 38 | | for services for persons with intellectual and developmental |
---|
39 | 39 | | disabilities, including persons with a dual diagnosis of |
---|
40 | 40 | | intellectual and developmental disabilities and mental illness. |
---|
41 | 41 | | (e) Not later than August 31, 2025, the Health and Human |
---|
42 | 42 | | Services Commission, in collaboration with stakeholders, shall |
---|
43 | 43 | | evaluate the closure process, including how well the closure plan |
---|
44 | 44 | | worked and outcomes for residents transitioned, and, if |
---|
45 | 45 | | appropriate, shall develop recommended policies for future |
---|
46 | 46 | | closures of other state supported living centers. |
---|
47 | 47 | | SECTION 2. EXPIRATION. This Act expires August 31, 2025. |
---|
48 | 48 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
---|
49 | 49 | | immediately if it receives a vote of two-thirds of all the members |
---|
50 | 50 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
51 | 51 | | Constitution. If this Act does not receive the vote necessary for |
---|
52 | 52 | | immediate effect, this Act takes effect September 1, 2019. |
