9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 433.0245, Health and Safety Code, is | |
11 | 11 | amended by adding Subsections (e) and (f) to read as follows: | |
12 | 12 | (e) For the purposes of this section, a low-volume livestock | |
13 | 13 | processing establishment: | |
14 | 14 | (1) includes a poultry processing establishment that | |
15 | 15 | processes more than 1,000 but not more than 20,000 poultry raised by | |
16 | 16 | the operator of the establishment in a calendar year; and | |
17 | 17 | (2) does not include a poultry processing | |
18 | 18 | establishment that processes 1,000 or fewer poultry raised by the | |
19 | 19 | operator of the establishment in a calendar year. | |
20 | 20 | (f) A poultry processing establishment described by | |
21 | 21 | Subsection (e)(2): | |
22 | 22 | (1) is not subject to additional state regulation; and | |
23 | 23 | (2) may sell poultry products directly to: | |
24 | 24 | (A) consumers; and | |
25 | 25 | (B) restaurants that provide food for immediate | |
26 | 26 | human consumption. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2019. |
