55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of certain low-volume poultry processing
88 establishments.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 433.0245, Health and Safety Code, is
1111 amended by adding Subsections (e) and (f) to read as follows:
1212 (e) For the purposes of this section, a low-volume livestock
1313 processing establishment:
1414 (1) includes a poultry processing establishment that
1515 processes more than 1,000 but not more than 20,000 poultry raised by
1616 the operator of the establishment in a calendar year; and
1717 (2) does not include a poultry processing
1818 establishment that processes 1,000 or fewer poultry raised by the
1919 operator of the establishment in a calendar year.
2020 (f) A poultry processing establishment described by
2121 Subsection (e)(2):
2222 (1) is not subject to additional state regulation; and
2323 (2) may sell poultry products directly to:
2424 (A) consumers; and
2525 (B) restaurants that provide food for immediate
2626 human consumption.
2727 SECTION 2. This Act takes effect September 1, 2019.
