810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Title 2, Water Code, is amended by adding
1012 Subtitle G to read as follows:
1113 SUBTITLE G. MISCELLANEOUS PROVISIONS
1214 CHAPTER 39. STANDARDS FOR SURFACE WATER AND GROUNDWATER MANAGEMENT
1315 IN CERTAIN AREAS
1416 Sec. 39.0101. STANDARDS FOR SURFACE WATER AND GROUNDWATER
1517 MANAGEMENT IN CERTAIN AREAS. (a) This section applies to a county:
1618 (1) bordering the Rio Grande;
1719 (2) overlying the Edwards-Trinity Aquifer; and
1820 (3) with a population greater than 40,000.
1921 (b) The Texas Water Development Board in coordination with
2022 the Texas Commission on Environmental Quality and the Parks and
2123 Wildlife Department shall adopt standards for water management by a
2224 conservation and reclamation district in a county to which this
2325 section applies.
2426 (c) Standards adopted under this section must address:
2527 (1) groundwater management; and
2628 (2) river and spring flow, including flow requirements
2729 for:
2830 (A) the Devils River;
2931 (B) the Pecos River; and
3032 (C) San Felipe Springs.
3133 SECTION 2. The Texas Water Development Board, Texas
3234 Commission on Environmental Quality, and Parks and Wildlife
3335 Department shall use existing funds to adopt standards as required
3436 by Section 39.0101, Water Code, as added by this Act.
3537 SECTION 3. This Act takes effect September 1, 2019.
