410 AN ACT
511 relating to the confidentiality of certain registered voters.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 13.004(c), Election Code, is amended to
814 read as follows:
915 (c) The following information furnished on a registration
1016 application is confidential and does not constitute public
1117 information for purposes of Chapter 552, Government Code:
1218 (1) a social security number;
1319 (2) a Texas driver's license number;
1420 (3) a number of a personal identification card issued
1521 by the Department of Public Safety;
1622 (4) an indication that an applicant is interested in
1723 working as an election judge;
1824 (5) the residence address of the applicant, if the
1925 applicant is a federal judge or state judge, as defined by Section
2026 13.0021, the spouse of a federal judge or state judge, the spouse of
2127 a peace officer as defined by Article 2.12, Code of Criminal
2228 Procedure, or an individual to whom Section 552.1175, Government
2329 Code, applies and the applicant:
2430 (A) included an affidavit with the registration
2531 application describing the applicant's status under this
2632 subdivision, including an affidavit under Section 13.0021 if the
2733 applicant is a federal judge or state judge or the spouse of a
2834 federal judge or state judge;
2935 (B) provided the registrar with an affidavit
3036 describing the applicant's status under this subdivision,
3137 including an affidavit under Section 15.0215 if the applicant is a
3238 federal judge or state judge or the spouse of a federal judge or
3339 state judge; or
3440 (C) provided the registrar with a completed form
3541 approved by the secretary of state for the purpose of notifying the
3642 registrar of the applicant's status under this subdivision;
3743 (6) the residence address of the applicant, if the
3844 applicant, the applicant's child, or another person in the
3945 applicant's household is a victim of family violence as defined by
4046 Section 71.004, Family Code, who provided the registrar with:
4147 (A) a copy of a protective order issued under
4248 Chapter 85, Family Code, or a magistrate's order for emergency
4349 protection issued under Article 17.292, Code of Criminal Procedure;
4450 or
4551 (B) other independent documentary evidence
4652 necessary to show that the applicant, the applicant's child, or
4753 another person in the applicant's household is a victim of family
4854 violence;
4955 (7) the residence address of the applicant, if the
5056 applicant, the applicant's child, or another person in the
5157 applicant's household is a victim of sexual assault or abuse,
5258 stalking, or trafficking of persons who provided the registrar
5359 with:
5460 (A) a copy of a protective order issued under
5561 Chapter 7A or Article 6.09, Code of Criminal Procedure, or a
5662 magistrate's order for emergency protection issued under Article
5763 17.292, Code of Criminal Procedure; or
5864 (B) other independent documentary evidence
5965 necessary to show that the applicant, the applicant's child, or
6066 another person in the applicant's household is a victim of sexual
6167 assault or abuse, stalking, or trafficking of persons; or
6268 (8) the residence address of the applicant, if the
6369 applicant:
6470 (A) is a participant in the address
6571 confidentiality program administered by the attorney general under
6672 Subchapter C, Chapter 56, Code of Criminal Procedure; and
6773 (B) provided the registrar with proof of
6874 certification under Article 56.84, Code of Criminal Procedure.
6975 SECTION 2. This Act takes effect immediately if it receives
7076 a vote of two-thirds of all the members elected to each house, as
7177 provided by Section 39, Article III, Texas Constitution. If this
7278 Act does not receive the vote necessary for immediate effect, this
7379 Act takes effect September 1, 2019.
