66 AN ACT
77 relating to notice of the right to object to participation in an
88 abortion procedure for health care personnel of a hospital or
99 health care facility.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 103, Occupations Code, is amended by
1212 adding Section 103.005 to read as follows:
1313 Sec. 103.005. REQUIRED NOTICE. A hospital or health care
1414 facility shall provide written notice to each physician, nurse,
1515 staff member, or employee of the hospital or facility that:
1616 (1) the individual has a right to object to directly or
1717 indirectly performing or participating in an abortion procedure;
1818 (2) the hospital or facility is prohibited from
1919 discriminating against the individual for refusing to perform or
2020 participate in an abortion procedure; and
2121 (3) the individual may be entitled to a remedy,
2222 including injunctive relief, affirmative relief, and any other
2323 necessary relief, under Section 103.003 for a violation of the
2424 individual's right to object.
2525 SECTION 2. This Act takes effect September 1, 2019.
