55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of certain municipalities to pledge
88 certain tax revenue for the payment of obligations related to hotel
99 projects.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 351.102(e) and (g), Tax Code, are
1212 amended to read as follows:
1313 (e) In addition to the municipalities described by
1414 Subsection (b), that subsection also applies to:
1515 (1) a municipality with a population of at least
1616 110,000 but not more than 135,000 at least part of which is located
1717 in a county with a population of not more than 135,000;
1818 (2) a municipality with a population of at least 9,000
1919 but not more than 10,000 that is located in two counties, each of
2020 which has a population of at least 662,000 and a southern border
2121 with a county with a population of 2.3 million or more;
2222 (3) a municipality with a population of at least
2323 200,000 but not more than 300,000 that contains a component
2424 institution of the Texas Tech University System;
2525 (4) a municipality with a population of at least
2626 95,000 that borders Lake Lewisville;
2727 (5) a municipality that:
2828 (A) contains a portion of Cedar Hill State Park;
2929 (B) has a population of more than 45,000;
3030 (C) is located in two counties, one of which has a
3131 population of more than two million and one of which has a
3232 population of more than 149,000; and
3333 (D) has adopted a capital improvement plan for
3434 the construction or expansion of a convention center facility;
3535 (6) a municipality with a population of less than
3636 6,000 that:
3737 (A) is located in two counties each with a
3838 population of 600,000 or more that are both adjacent to a county
3939 with a population of two million or more;
4040 (B) has full-time police and fire departments;
4141 and
4242 (C) has adopted a capital improvement plan for
4343 the construction or expansion of a convention center facility;
4444 (7) a municipality with a population of at least
4545 56,000 that:
4646 (A) borders Lake Ray Hubbard; and
4747 (B) is located in two counties, one of which has a
4848 population of less than 80,000;
4949 (8) a municipality with a population of more than
5050 83,000, that borders Clear Lake, and that is primarily located in a
5151 county with a population of less than 300,000;
5252 (9) a municipality with a population of less than
5353 2,000 that:
5454 (A) is located adjacent to a bay connected to the
5555 Gulf of Mexico;
5656 (B) is located in a county with a population of
5757 290,000 or more that is adjacent to a county with a population of
5858 four million or more; and
5959 (C) has a boardwalk on the bay;
6060 (10) a municipality with a population of 75,000 or
6161 more that:
6262 (A) is located wholly in one county with a
6363 population of 575,000 or more that is adjacent to a county with a
6464 population of four million or more; and
6565 (B) has adopted a capital improvement plan for
6666 the construction or expansion of a convention center facility;
6767 (11) a municipality with a population of less than
6868 75,000 that is located in three counties, at least one of which has
6969 a population of at least four million; [and]
7070 (12) an eligible coastal municipality with a
7171 population of more than 3,000 but less than 5,000; and
7272 (13) a municipality that contains a portion of U.S.
7373 Highway 79 and State Highway 130.
7474 (g) A municipality to which this section applies may not
7575 receive or pledge revenue or funds under Subsection (b) or (c) for a
7676 hotel project unless the municipality enters into an agreement with
7777 a person for the development of the hotel project before September
7878 1, 2021 [2019].
7979 SECTION 2. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2019.
