7 | 13 | | persons with intellectual and developmental disabilities. |

8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
9 | 15 | | SECTION 1. (a) In this section, "task force" means the task |
---|
10 | 16 | | force on best practice standards for the detention of persons with |
---|
11 | 17 | | intellectual and developmental disabilities established under this |
---|
12 | 18 | | section. |
---|
13 | 19 | | (b) The task force is established to conduct a comprehensive |
---|
14 | 20 | | study on best practice standards for the detention of a person with |
---|
15 | 21 | | an intellectual or developmental disability. The study must |
---|
16 | 22 | | identify and make recommendations regarding the following with |
---|
17 | 23 | | respect to the detention of persons with intellectual and |
---|
18 | 24 | | developmental disabilities: |
---|
19 | 25 | | (1) current policies and procedures; |
---|
20 | 26 | | (2) barriers to accommodations and justice; |
---|
21 | 27 | | (3) best practices used in other states; |
---|
22 | 28 | | (4) policies that would improve jail standards; and |
---|
23 | 29 | | (5) any other issue the task force considers |
---|
24 | 30 | | appropriate. |
---|
25 | 31 | | (c) The Commission on Jail Standards shall appoint the |
---|
26 | 32 | | members of the task force. The task force must include at least: |
---|
27 | 33 | | (1) one representative of the Commission on Jail |
---|
28 | 34 | | Standards; |
---|
29 | 35 | | (2) one representative of a statewide organization |
---|
30 | 36 | | that advocates for individuals with intellectual and developmental |
---|
31 | 37 | | disabilities; |
---|
32 | 38 | | (3) one representative of a city or county |
---|
33 | 39 | | governmental agency that supports persons with intellectual and |
---|
34 | 40 | | developmental disabilities; |
---|
35 | 41 | | (4) one representative of a city or county |
---|
36 | 42 | | governmental agency that provides mental health services; |
---|
37 | 43 | | (5) one representative of a statewide organization |
---|
38 | 44 | | that represents municipalities; |
---|
39 | 45 | | (6) one representative of a statewide organization |
---|
40 | 46 | | that represents corrections professionals; |
---|
41 | 47 | | (7) one representative of a law enforcement entity; |
---|
42 | 48 | | and |
---|
43 | 49 | | (8) one representative of a county jail. |
---|
44 | 50 | | (d) The member appointed under Subsection (c)(1) of this |
---|
45 | 51 | | section serves as the presiding officer of the task force. |
---|
46 | 52 | | (e) The task force shall prepare a written report that |
---|
47 | 53 | | includes: |
---|
48 | 54 | | (1) a description of the activities of the task force; |
---|
49 | 55 | | (2) the findings and recommendations of the task |
---|
50 | 56 | | force; |
---|
51 | 57 | | (3) a plan for how the best practice standards |
---|
52 | 58 | | identified by the task force can be implemented statewide; |
---|
53 | 59 | | (4) any proposals for legislation; and |
---|
54 | 60 | | (5) any other matter the task force considers |
---|
55 | 61 | | appropriate. |
---|
56 | 62 | | (f) Not later than December 1, 2020, the task force shall |
---|
57 | 63 | | submit the report prepared under this section to: |
---|
58 | 64 | | (1) the governor; |
---|
59 | 65 | | (2) the lieutenant governor; |
---|
60 | 66 | | (3) the speaker of the house of representatives; and |
---|
61 | 67 | | (4) the presiding officers of the standing committees |
---|
62 | 68 | | of the senate and house of representatives having primary |
---|
63 | 69 | | jurisdiction over issues relating to criminal justice. |
---|
64 | 70 | | (g) The Commission on Jail Standards shall make the report |
---|
65 | 71 | | available to the public on the commission's Internet website. |
---|
66 | 72 | | (h) The task force is abolished and this Act expires |
---|
67 | 73 | | September 1, 2021. |
---|
68 | 74 | | SECTION 2. This Act takes effect September 1, 2019. |
