9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to developing the proposed plan on long-term care for
612 persons with an intellectual disability.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 533A.062, Health and Safety Code, is
915 amended by adding Subsection (b-1) to read as follows:
1016 (b-1) As part of the proposed plan, the commission shall
1117 review the statewide bed capacity of community ICF-IID facilities
1218 for individuals with an intellectual disability or a related
1319 condition and, based on the review, develop a process to reallocate
1420 beds held in suspension by the commission. The process may include:
1521 (1) criteria by which ICF-IID program providers may
1622 apply to the commission to receive reallocated beds; and
1723 (2) a means to reallocate the beds among health
1824 services regions.
1925 SECTION 2. This Act takes effect immediately if it receives
2026 a vote of two-thirds of all the members elected to each house, as
2127 provided by Section 39, Article III, Texas Constitution. If this
2228 Act does not receive the vote necessary for immediate effect, this
2329 Act takes effect September 1, 2019.
