| 5 | 11 | | relating to developing the proposed plan on long-term care for |
|---|
| 6 | 12 | | persons with an intellectual disability. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 14 | | SECTION 1. Section 533A.062, Health and Safety Code, is |
|---|
| 9 | 15 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 10 | 16 | | (b-1) As part of the proposed plan, the commission shall |
|---|
| 11 | 17 | | review the statewide bed capacity of community ICF-IID facilities |
|---|
| 12 | 18 | | for individuals with an intellectual disability or a related |
|---|
| 13 | 19 | | condition and, based on the review, develop a process to reallocate |
|---|
| 14 | 20 | | beds held in suspension by the commission. The process may include: |
|---|
| 15 | 21 | | (1) criteria by which ICF-IID program providers may |
|---|
| 16 | 22 | | apply to the commission to receive reallocated beds; and |
|---|
| 17 | 23 | | (2) a means to reallocate the beds among health |
|---|
| 18 | 24 | | services regions. |
|---|
| 19 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 29 | | Act takes effect September 1, 2019. |
