| 8 | 8 | | pornography unit within the Department of Public Safety of the |

| 9 | 9 | | State of Texas. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 411.02096 to read as follows: |
|---|
| 13 | 13 | | Sec. 411.02096. HUMAN TRAFFICKING AND CHILD PORNOGRAPHY |
|---|
| 14 | 14 | | UNIT. (a) In this section: |
|---|
| 15 | 15 | | (1) "Child pornography" means conduct that |
|---|
| 16 | 16 | | constitutes an offense under Section 43.26, Penal Code. |
|---|
| 17 | 17 | | (2) "Human trafficking" means conduct that |
|---|
| 18 | 18 | | constitutes an offense under Section 20A.02, Penal Code. |
|---|
| 19 | 19 | | (3) "Unit" means the human trafficking and child |
|---|
| 20 | 20 | | pornography unit established by this section. |
|---|
| 21 | 21 | | (b) A human trafficking and child pornography unit is |
|---|
| 22 | 22 | | created within the department to investigate and combat human |
|---|
| 23 | 23 | | trafficking and child pornography. |
|---|
| 24 | 24 | | (c) The unit shall collaborate with federal and local law |
|---|
| 25 | 25 | | enforcement agencies to investigate human trafficking and child |
|---|
| 26 | 26 | | pornography and arrest persons determined to have engaged in human |
|---|
| 27 | 27 | | trafficking or child pornography. |
|---|
| 28 | 28 | | (d) The department may adopt rules as necessary to implement |
|---|
| 29 | 29 | | this section. |
|---|
| 30 | 30 | | (e) The director may transfer the resources dedicated to the |
|---|
| 31 | 31 | | unit to other programs within the department if the director |
|---|
| 32 | 32 | | determines that incidents of human trafficking and child |
|---|
| 33 | 33 | | pornography have decreased throughout the state to such an extent |
|---|
| 34 | 34 | | that the resources would better serve the interests of public |
|---|
| 35 | 35 | | safety if otherwise employed. The director shall notify the |
|---|
| 36 | 36 | | legislature at least 180 days before making the transfer under this |
|---|
| 37 | 37 | | subsection. |
|---|
| 38 | 38 | | SECTION 2. Not later than September 1, 2020, the Department |
|---|
| 39 | 39 | | of Public Safety of the State of Texas shall establish the human |
|---|
| 40 | 40 | | trafficking and child pornography unit under Section 411.02096, |
|---|
| 41 | 41 | | Government Code, as added by this Act. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2019. |
