410 AN ACT
511 relating to parking for persons with disabilities.
612 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
713 SECTION 1. Section 469.052, Government Code, is amended by
814 adding Subsection (b-1) to read as follows:
915 (b-1) Subject to Subsection (b), the standards and
1016 specifications adopted by the commission under this chapter must
1117 provide that:
1218 (1) if an accessible parking space provided in
1319 accordance with a requirement of the standards and specifications
1420 is paved:
1521 (A) the international symbol of access must be
1622 painted on the parking space; and
1723 (B) the words "NO PARKING" must be painted on any
1824 access aisle adjacent to the parking space; and
1925 (2) a sign identifying an accessible parking space
2026 provided in accordance with a requirement of the standards and
2127 specifications must include a statement regarding the potential
2228 consequences of illegally parking a vehicle in the space, including
2329 the towing of the vehicle or the assessment of a fine or other
2430 penalty against the vehicle owner or operator.
2531 SECTION 2. Subchapter C, Chapter 504, Transportation Code,
2632 is amended by adding Section 504.205 to read as follows:
2733 Sec. 504.205. INFORMATION PROVIDED WITH PLATES. The
2834 department shall include with each set of specialty license plates
2935 issued under this subchapter a document that provides:
3036 (1) information on laws governing parking for persons
3137 with disabilities; and
3238 (2) instructions for reporting alleged violations of
3339 Chapter 681.
3440 SECTION 3. Section 681.004, Transportation Code, is amended
3541 by adding Subsection (e) to read as follows:
3642 (e) The department shall include with each disabled parking
3743 placard a document that provides:
3844 (1) information on laws governing parking for persons
3945 with disabilities; and
4046 (2) instructions for reporting alleged violations of
4147 this chapter.
4248 SECTION 4. Section 681.009(b), Transportation Code, is
4349 amended to read as follows:
4450 (b) A political subdivision must designate a parking space
4551 or area by conforming to the standards and specifications adopted
4652 by the Texas Commission of Licensing and Regulation under Section
4753 469.052, Government Code [5(i), Article 9102, Revised Statutes],
4854 relating to the identification and dimensions of parking spaces for
4955 persons with disabilities. A person who owns or controls private
5056 property used for parking may designate a parking space or area
5157 without conforming to those standards and specifications, unless
5258 required to conform by law.
5359 SECTION 5. This Act takes effect September 1, 2019.
