66 AN ACT
77 relating to prohibiting a person from opening a line of credit in a
88 minor's name without parental approval.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 34.305, Finance Code, is amended by
1111 adding Subsection (f) to read as follows:
1212 (f) Subsection (a) does not authorize the bank to open a
1313 line of credit in the name of the minor without the prior approval
1414 of the minor's parent or legal guardian, unless the minor's
1515 disabilities of minority have been removed for this purpose.
1616 SECTION 2. Section 65.101, Finance Code, is amended by
1717 adding Subsection (g) to read as follows:
1818 (g) This section does not authorize the association to open
1919 a line of credit in the name of the minor without the prior approval
2020 of the minor's parent or legal guardian, unless the minor's
2121 disabilities of minority have been removed for this purpose.
2222 SECTION 3. Section 95.101, Finance Code, is amended by
2323 adding Subsection (g) to read as follows:
2424 (g) This section does not authorize the savings bank to open
2525 a line of credit in the name of the minor without the prior approval
2626 of the minor's parent or legal guardian, unless the minor's
2727 disabilities of minority have been removed for this purpose.
2828 SECTION 4. Section 125.201, Finance Code, is amended to
2929 read as follows:
3030 Sec. 125.201. POWERS OF CREDIT UNION RELATING TO ACCOUNT.
3131 (a) A credit union may:
3232 (1) open a share or deposit account in the name of a
3333 minor;
3434 (2) receive a payment on the account by or for the
3535 minor;
3636 (3) pay withdrawals;
3737 (4) accept pledges to the credit union by or for the
3838 minor; and
3939 (5) act in any other matter with respect to an account
4040 on the order of a minor.
4141 (b) This section does not authorize the credit union to open
4242 a line of credit in the name of the minor without the prior approval
4343 of the minor's parent or legal guardian, unless the minor's
4444 disabilities of minority have been removed for this purpose.
4545 SECTION 5. Subtitle Z, Title 3, Finance Code, is amended by
4646 adding Chapter 282 to read as follows:
4747 CHAPTER 282. LINES OF CREDIT
4848 Sec. 282.001. RESTRICTION ON LINE OF CREDIT FOR MINOR. (a)
4949 In this section, "financial institution" has the meaning assigned
5050 by Section 277.001.
5151 (b) Notwithstanding any other law, a financial institution
5252 or other person may not open a line of credit in the name of a minor
5353 without the prior approval of the minor's parent or legal guardian,
5454 unless the minor's disabilities of minority have been removed for
5555 this purpose.
5656 SECTION 6. The changes in law made by this Act apply only to
5757 a line of credit opened on or after the effective date of this Act.
5858 A line of credit opened before the effective date of this Act is
5959 governed by the law in effect on the date the line of credit was
6060 opened, and the former law is continued in effect for that purpose.
6161 SECTION 7. This Act takes effect September 1, 2019.
