9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 43.002(e), Local Government Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (e) Notwithstanding Subsection (c) and until the 20th |
---|
13 | 13 | | anniversary of the date of the annexation of an area that includes a |
---|
14 | 14 | | permanent retail structure, a municipality may not prohibit a |
---|
15 | 15 | | person from continuing to use the structure for the indoor seasonal |
---|
16 | 16 | | sale of retail goods if the annexation became final on or after |
---|
17 | 17 | | January 1, 2017, and the structure: |
---|
18 | 18 | | (1) is more than 5,000 square feet; and |
---|
19 | 19 | | (2) was authorized under the laws of this state to be |
---|
20 | 20 | | used for the indoor seasonal sale of retail goods on the effective |
---|
21 | 21 | | date of the annexation. |
---|
22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
---|
23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
---|
24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
---|
26 | 26 | | Act takes effect September 1, 2019. |
