412 AN ACT
513 relating to the classification and operation of mopeds and certain
614 motorcycles.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 ARTICLE 1. MOPED OPERATION
917 SECTION 1.01. Section 521.084, Transportation Code, is
1018 amended to read as follows:
1119 Sec. 521.084. CLASS M LICENSE. A Class M driver's license
1220 authorizes the holder of the license to operate a motorcycle [or
1321 moped] as defined by Section 541.201.
1422 SECTION 1.02. Section 521.085(a), Transportation Code, is
1523 amended to read as follows:
1624 (a) Unless prohibited by Chapter 522, and except as provided
1725 by Subsection (b), the license holder may operate any vehicle of the
1826 type for which that class of license is issued and any lesser type
1927 of vehicle other than a motorcycle [or moped].
2028 SECTION 1.03. Section 521.122(b), Transportation Code, is
2129 amended to read as follows:
2230 (b) The department may include on the driver's license an
2331 authorization to operate a motorcycle [or moped] if the license
2432 holder has met all requirements for a Class M license.
2533 SECTION 1.04. Section 521.421(f), Transportation Code, as
2634 added by Chapter 1372 (H.B. 1200), Acts of the 75th Legislature,
2735 Regular Session, 1997, is redesignated as Section 521.421(g),
2836 Transportation Code, and amended to read as follows:
2937 (g) [(f)] If a Class A, B, or C driver's license includes an
3038 authorization to operate a motorcycle [or moped], the fee for the
3139 driver's license is increased by $8.
3240 SECTION 1.05. Section 522.029(f), Transportation Code, is
3341 amended to read as follows:
3442 (f) If a commercial driver's license includes an
3543 authorization to operate a motorcycle [or moped], the fee for the
3644 driver's license is increased by $8.
3745 SECTION 1.06. Section 522.041(e), Transportation Code, is
3846 amended to read as follows:
3947 (e) The holder of a commercial driver's license or
4048 commercial learner's permit may drive any vehicle in the class for
4149 which the license or permit is issued and lesser classes of vehicles
4250 except a motorcycle [or moped]. The holder may drive a motorcycle
4351 only if authorization to drive a motorcycle is shown on the
4452 commercial driver's license and the requirements for issuance of a
4553 motorcycle license have been met.
4654 SECTION 1.07. Sections 541.201(8) and (9), Transportation
4755 Code, are amended to read as follows:
4856 (8) "Moped" means a motor vehicle that is equipped
4957 with a rider's saddle and designed to have when propelled not more
5058 than three wheels on the ground, [motor-driven cycle] that cannot
5159 attain a speed in one mile of more than 30 miles per hour, and the
5260 engine of which:
5361 (A) cannot produce more than five-brake
5462 [two-brake] horsepower; and
5563 (B) if an internal combustion engine, has a
5664 piston displacement of 50 cubic centimeters or less and connects to
5765 a power drive system that does not require the operator to shift
5866 gears.
5967 (9) "Motorcycle" means a motor vehicle, other than a
6068 tractor or moped, that is equipped with a rider's saddle and
6169 designed to have when propelled not more than three wheels on the
6270 ground.
6371 ARTICLE 2. CONFORMING AMENDMENTS
6472 SECTION 2.01. Section 345.251(a), Finance Code, is amended
6573 to read as follows:
6674 (a) A retail seller may charge a documentary fee for
6775 services rendered to, for, or on behalf of a retail buyer in
6876 handling and processing documents relating to the sale of a
6977 motorcycle, [motor-driven cycle,] moped, all-terrain vehicle,
7078 boat, boat motor, boat trailer, or towable recreational vehicle.
7179 SECTION 2.02. Section 501.002(17), Transportation Code, is
7280 amended to read as follows:
7381 (17) "Motor vehicle" means:
7482 (A) any motor driven or propelled vehicle
7583 required to be registered under the laws of this state;
7684 (B) a trailer or semitrailer, other than
7785 manufactured housing, that has a gross vehicle weight that exceeds
7886 4,000 pounds;
7987 (C) a travel trailer;
8088 (D) an all-terrain vehicle or a recreational
8189 off-highway vehicle, as those terms are defined by Section 502.001,
8290 designed by the manufacturer for off-highway use that is not
8391 required to be registered under the laws of this state; or
8492 (E) a motorcycle [, motor-driven cycle,] or moped
8593 that is not required to be registered under the laws of this state.
8694 SECTION 2.03. Section 502.001(7), Transportation Code, is
8795 amended to read as follows:
8896 (7) "Commercial motor vehicle" means a motor vehicle,
8997 other than a motorcycle or moped, designed or used primarily to
9098 transport property. The term includes a passenger car
9199 reconstructed and used primarily for delivery purposes. The term
92100 does not include a passenger car used to deliver the United States
93101 mail.
94102 SECTION 2.04. Section 544.0075(b), Transportation Code, is
95103 amended to read as follows:
96104 (b) In addition to any other type of vehicle the presence of
97105 which the detector for the traffic-actuated electric
98106 traffic-control signal may register, the detector for a
99107 traffic-actuated electric traffic-control device to which this
100108 section applies must be capable of registering the presence of a
101109 motorcycle or moped.
102110 SECTION 2.05. Sections 545.065(a) and (c), Transportation
103111 Code, are amended to read as follows:
104112 (a) The Texas Transportation Commission by resolution or
105113 order recorded in its minutes may prohibit the use of a
106114 limited-access or controlled-access highway under the jurisdiction
107115 of the commission by a parade, funeral procession, pedestrian,
108116 bicycle, electric bicycle, motorcycle equipped with a motor that
109117 has an engine piston displacement of 250 cubic centimeters or less
110118 [motor-driven cycle], or nonmotorized traffic.
111119 (c) A local authority by ordinance may prohibit the use of a
112120 limited-access or controlled-access roadway under the jurisdiction
113121 of the authority by a parade, funeral procession, pedestrian,
114122 bicycle, electric bicycle, motorcycle equipped with a motor that
115123 has an engine piston displacement of 250 cubic centimeters or less
116124 [motor-driven cycle], or nonmotorized traffic.
117125 SECTION 2.06. Section 545.361(a), Transportation Code, is
118126 amended to read as follows:
119127 (a) An operator of a moped or a motorcycle equipped with a
120128 motor that has an engine piston displacement of 250 cubic
121129 centimeters or less [motor-driven cycle] may not drive at a speed of
122130 more than 35 miles per hour during the time specified by Section
123131 547.302(a) unless the motorcycle or moped [cycle] is equipped with
124132 a headlamp or lamps that reveal a person or vehicle 300 feet ahead.
125133 SECTION 2.07. Section 545.416, Transportation Code, is
126134 amended to read as follows:
127135 Sec. 545.416. RIDING ON MOTORCYCLE OR MOPED. (a) An
128136 operator of a motorcycle or moped shall ride on the permanent and
129137 regular seat attached to the motorcycle or moped.
130138 (b) An operator may not carry another person on the
131139 motorcycle or moped, and a person who is not operating the
132140 motorcycle or moped may not ride on the motorcycle or moped, unless
133141 the motorcycle or moped is:
134142 (1) designed to carry more than one person; and
135143 (2) equipped with footrests and handholds for use by
136144 the passenger.
137145 (c) If the motorcycle or moped is designed to carry more
138146 than one person, a passenger may ride only on the permanent and
139147 regular seat, if designed for two persons, or on another seat firmly
140148 attached to the motorcycle or moped behind or to the side of the
141149 operator.
142150 (d) Except as provided by Subsection (e), an operator may
143151 not carry another person on a motorcycle or moped unless the other
144152 person is at least five years of age. An offense under this
145153 subsection is a misdemeanor punishable by a fine of not less than
146154 $100 or more than $200. It is a defense to prosecution under this
147155 subsection that the operator was operating the motorcycle or moped
148156 in an emergency or for a law enforcement purpose.
149157 (e) Subsection (d) does not prohibit an operator from
150158 carrying on a motorcycle or moped a person younger than five years
151159 of age who is seated in a sidecar attached to the motorcycle or
152160 moped.
153161 (f) For purposes of Subsections (c) and (d), an autocycle as
154162 defined by Section 501.008 is considered to be a motorcycle.
155163 SECTION 2.08. Section 545.424, Transportation Code, is
156164 amended by adding Subsection (a-2) and amending Subsections (b) and
157165 (b-1) to read as follows:
158166 (a-2) Notwithstanding Subsection (a-1), a person under 18
159167 years of age may operate a moped after midnight and before 5 a.m. if
160168 the person is in sight of the person's parent or guardian.
161169 (b) A person under 17 years of age who holds a restricted
162170 motorcycle license [or moped license] may not operate a motorcycle
163171 [or moped] while using a wireless communication device, except in
164172 case of emergency. This subsection does not apply to a person
165173 licensed by the Federal Communications Commission while operating a
166174 radio frequency device other than a wireless communication device.
167175 (b-1) A person under 17 years of age who holds a restricted
168176 motorcycle license [or moped license], during the 12-month period
169177 following the issuance of an original motorcycle license [or moped
170178 license] to the person, may not operate a motorcycle [or moped]
171179 after midnight and before 5 a.m. unless:
172180 (1) the person is in sight of the person's parent or
173181 guardian; or
174182 (2) the operation of the vehicle is necessary for the
175183 operator to attend or participate in employment or a school-related
176184 activity or because of a medical emergency.
177185 SECTION 2.09. Section 547.306, Transportation Code, is
178186 amended to read as follows:
179187 Sec. 547.306. LED GROUND EFFECT LIGHTING EQUIPMENT ON
180188 MOTORCYCLE OR MOPED. (a) In this section, "LED ground effect
181189 lighting equipment" means light emitting diode (LED) technology
182190 that is attached to the underbody of a motorcycle or moped for the
183191 purpose of illuminating:
184192 (1) the body of the motorcycle or moped; or
185193 (2) the ground below the motorcycle or moped.
186194 (b) A person may operate a motorcycle or moped equipped with
187195 LED ground effect lighting that emits a non-flashing amber or white
188196 light.
189197 SECTION 2.10. Sections 547.333(a) and (d), Transportation
190198 Code, are amended to read as follows:
191199 (a) Unless provided otherwise, a headlamp, auxiliary
192200 driving lamp, auxiliary passing lamp, or combination of those lamps
193201 mounted on a motor vehicle, other than a motorcycle or moped
194202 [motor-driven cycle]:
195203 (1) shall be arranged so that the operator can select
196204 at will between distributions of light projected at different
197205 elevations; and
198206 (2) may be arranged so that the operator can select the
199207 distribution automatically.
200208 (d) A motor vehicle of a model year of 1948 or later, other
201209 than a motorcycle or moped [motor-driven cycle], that has
202210 multiple-beam lighting equipment shall be equipped with a beam
203211 indicator that is:
204212 (1) designed and located so that the lighted indicator
205213 is visible without glare to the vehicle operator; and
206214 (2) lighted only when the uppermost distribution of
207215 light is in use.
208216 SECTION 2.11. Sections 547.383(a) and (b), Transportation
209217 Code, are amended to read as follows:
210218 (a) A vehicle, other than a moped or a motorcycle equipped
211219 with a motor that has an engine piston displacement of 250 cubic
212220 centimeters or less [motor-driven cycle], shall be equipped with at
213221 least one lamp, or a combination of lamps, that:
214222 (1) emits a white or amber light visible at a distance
215223 of 1,000 feet from the front and a red light visible at a distance of
216224 1,000 feet from the rear; and
217225 (2) is mounted so that at least one lamp is installed
218226 as near as practicable to the side of the vehicle that is closest to
219227 passing traffic.
220228 (b) A vehicle, other than a moped or a motorcycle equipped
221229 with a motor that has an engine piston displacement of 250 cubic
222230 centimeters or less [motor-driven cycle], that is parked or stopped
223231 on a roadway or shoulder at a time specified in Section 547.302(a)
224232 shall display a lamp that complies with Subsection (a).
225233 SECTION 2.12. Section 547.404(a), Transportation Code, is
226234 amended to read as follows:
227235 (a) A vehicle required to have brakes by this subchapter,
228236 other than a motorcycle or moped [motor-driven cycle], shall be
229237 equipped with parking brakes adequate to hold the vehicle:
230238 (1) on any grade on which the vehicle is operated;
231239 (2) under all loading conditions; and
232240 (3) on a surface free from snow, ice, or loose
233241 material.
234242 SECTION 2.13. Section 547.408(a), Transportation Code, is
235243 amended to read as follows:
236244 (a) A motor vehicle or combination of vehicles shall be
237245 equipped with service brakes capable of:
238246 (1) developing a braking force that is not less than:
239247 (A) 52.8 percent of the gross weight of the
240248 vehicle for a passenger vehicle; or
241249 (B) 43.5 percent of the gross weight of the
242250 vehicle for a vehicle other than a passenger vehicle;
243251 (2) decelerating to a stop from 20 miles per hour or
244252 less at not less than:
245253 (A) 17 feet per second per second for a passenger
246254 vehicle; or
247255 (B) 14 feet per second per second for other
248256 vehicles; and
249257 (3) stopping from a speed of 20 miles per hour in a
250258 distance, measured from the location where the service brake pedal
251259 or control is activated, of not more than:
252260 (A) 25 feet for a passenger vehicle;
253261 (B) 30 feet for a motorcycle, moped [motor-driven
254262 cycle], or single unit vehicle with a manufacturer's gross vehicle
255263 weight rating of 10,000 pounds or less;
256264 (C) 40 feet for:
257265 (i) a single unit vehicle with a
258266 manufacturer's gross weight rating of more than 10,000 pounds;
259267 (ii) a two-axle towing vehicle and trailer
260268 combination with a weight of 3,000 pounds or less;
261269 (iii) a bus that does not have a
262270 manufacturer's gross weight rating; and
263271 (iv) the combination of vehicles in an
264272 operation exempted by Section 547.407(b); and
265273 (D) 50 feet for other vehicles.
266274 SECTION 2.14. Section 547.617, Transportation Code, is
267275 amended to read as follows:
268276 Sec. 547.617. MOTORCYCLE AND MOPED FOOTRESTS AND HANDHOLDS
269277 REQUIRED. (a) A motorcycle or moped that is designed to carry more
270278 than one person must be equipped with footrests and handholds for
271279 use by the passenger.
272280 (b) This section does not apply to an autocycle as defined
273281 by Section 501.008 or a motorcycle as defined by Section
274282 521.001(a)(6-a).
275283 SECTION 2.15. The heading to Subchapter M, Chapter 547,
276284 Transportation Code, is amended to read as follows:
277285 SUBCHAPTER M. ADDITIONAL OR ALTERNATIVE EQUIPMENT REQUIREMENTS FOR
278286 MOTORCYCLES AND MOPEDS [MOTOR-DRIVEN CYCLES]
279287 SECTION 2.16. Sections 547.801(a), (b), and (c),
280288 Transportation Code, are amended to read as follows:
281289 (a) A motorcycle or a moped [, including a motor-driven
282290 cycle,] shall be equipped with:
283291 (1) not more than two headlamps mounted at a height
284292 from 24 to 54 inches;
285293 (2) at least one taillamp mounted at a height from 20
286294 to 72 inches;
287295 (3) a taillamp or separate lamp to illuminate the rear
288296 license plate that complies with the requirements of Sections
289297 547.322(f) and (g);
290298 (4) at least one stoplamp that complies with the
291299 requirements of Section 547.323(d); and
292300 (5) at least one rear red reflector that complies with
293301 the requirements of Section 547.325(b) and may be included as a part
294302 of the taillamp.
295303 (b) A motorcycle, other than a motorcycle equipped with a
296304 motor that has an engine piston displacement of 250 cubic
297305 centimeters or less [motor-driven cycle], shall be equipped with
298306 multiple-beam lighting equipment that produces:
299307 (1) an uppermost distribution of light that reveals a
300308 person or vehicle at a distance of at least 300 feet ahead; and
301309 (2) a lowermost distribution of light that:
302310 (A) reveals a person or vehicle at a distance of
303311 at least 150 feet ahead; and
304312 (B) is aimed so that no part of the
305313 high-intensity portion of the beam on the motorcycle that is on a
306314 straight and level road under any condition of loading projects
307315 into the eyes of an approaching vehicle operator.
308316 (c) A moped or a motorcycle equipped with a motor that has an
309317 engine piston displacement of 250 cubic centimeters or less
310318 [motor-driven cycle] shall be equipped with:
311319 (1) multiple-beam lighting equipment that complies
312320 with the requirements of Subsection (b); or
313321 (2) single-beam lighting equipment that:
314322 (A) emits light sufficient to reveal a person or
315323 vehicle:
316324 (i) at a distance of at least 100 feet when
317325 the moped or motorcycle [cycle] is operated at a speed less than 25
318326 miles per hour;
319327 (ii) at a distance of at least 200 feet when
320328 the moped or motorcycle [cycle] is operated at a speed of 25 miles
321329 per hour or more; and
322330 (iii) at a distance of at least 300 feet
323331 when the moped or motorcycle [cycle] is operated at a speed of 35
324332 miles per hour or more; and
325333 (B) is aimed so that no part of the
326334 high-intensity portion of the beam from the lamp on a loaded moped
327335 or motorcycle [cycle] projects a beam higher than the level center
328336 of the lamp for a distance of 25 feet ahead.
329337 SECTION 2.17. Section 547.802, Transportation Code, is
330338 amended to read as follows:
331339 Sec. 547.802. BRAKE EQUIPMENT. (a) If a motorcycle or a
332340 moped[, including a motor-driven cycle,] complies with the
333341 performance requirements of Section 547.408, brakes are not
334342 required on the wheel of a sidecar attached to the motorcycle or
335343 moped [cycle].
336344 (b) If a moped or a motorcycle equipped with a motor that has
337345 an engine piston displacement of 250 cubic centimeters or less
338346 [motor-driven cycle] complies with the performance standards of
339347 Section 547.408, brakes are not required on the front wheel of the
340348 moped or motorcycle [cycle].
341349 (c) The director may require an inspection of the [a
342350 motor-driven cycle] braking system of a moped or a motorcycle
343351 equipped with a motor that has an engine piston displacement of 250
344352 cubic centimeters or less and may disapprove a system that:
345353 (1) does not comply with the brake performance
346354 requirements in Section 547.408; or
347355 (2) is not designed or constructed to ensure
348356 reasonable and reliable performance during actual use.
349357 SECTION 2.18. Section 551.351(2), Transportation Code, is
350358 amended to read as follows:
351359 (2) "Pocket bike or minimotorbike" means a
352360 self-propelled vehicle that is equipped with an electric motor or
353361 internal combustion engine having a piston displacement of less
354362 than 50 cubic centimeters, is designed to propel itself with not
355363 more than two wheels in contact with the ground, has a seat or
356364 saddle for the use of the operator, is not designed for use on a
357365 highway, and is ineligible for a certificate of title under Chapter
358366 501. The term does not include:
359367 (A) a moped or motorcycle;
360368 (B) an electric bicycle [or motor-driven cycle,
361369 as defined by Section 541.201];
362370 (C) a motorized mobility device, as defined by
363371 Section 542.009;
364372 (D) an electric personal assistive mobility
365373 device, as defined by Section 551.201; or
366374 (E) a neighborhood electric vehicle, as defined
367375 by Section 551.301.
368376 SECTION 2.19. Section 662.011(a), Transportation Code, is
369377 amended to read as follows:
370378 (a) Of each fee collected under Sections 521.421(b) and (g)
371379 [(f)] and Sections 522.029(f) and (g), the Department of Public
372380 Safety shall send $5 to the comptroller for deposit to the credit of
373381 the motorcycle education fund account.
374382 ARTICLE 3. REPEALER
375383 SECTION 3.01. The following provisions of the
376384 Transportation Code are repealed:
377385 (1) Section 521.224(a);
378386 (2) Section 521.225; and
379387 (3) Section 541.201(10).
380388 ARTICLE 4. TEXAS MOBILITY FUND
381389 SECTION 4.01. As soon as practicable after the effective
382390 date of this Act, the comptroller of public accounts shall:
383391 (1) determine whether any transfer of money for
384392 deposit to the Texas mobility fund is necessary to comply with
385393 Section 49-k, Article III, Texas Constitution; and
386394 (2) transfer any amount determined to be necessary
387395 under Subdivision (1) to the Texas mobility fund from the general
388396 revenue fund.
389397 ARTICLE 5. EFFECTIVE DATE
390398 SECTION 5.01. This Act takes effect September 1, 2019.
